AnnieR Yes....As long as you enter the spouse's date of death, the ATX software will automatically place "Filing as surviving spouse" on the proper signatre lines and you can e-file as normal. Quote

The decision can ONLY be made by the executor or personal representative. While it is common for the surviving spouse to file this way, there is nothing in the original post to support such an assumption. Quote
