E-filed as Single - -just got Marriage license - -HELP!

After 29 tax years - -I thought I had heard it all!

Long time widower client passed away in Sept. He had been VERY good friends with a wonderful lady who was with him till the very end. He finally convinced her to get married, and a Rabbi came to the hospital to perform the service - - - they were, however, 28 minutes SHORT of the NYS 24 hrs between getting the license and getting married. The Rabbi did not discover this until AFTER the client passed away - - - - - new spouse goes to State Supreme Court for determination - -guess when it came - - - TODAY - - - -AFTER I DELIVERED HER 2 SINGLE TAX RETURNS TODAY!!!

Her tax return was e-filed TODAY with balances due both Fed & NYS (paper check was to be mailed) and HIS had refunds - -but were not efiled or mailed.

My question is - -HOW to amend her's and efile it TOMORROW without having her send in the $$ since there is now a pretty good refund . I believe I duplicate HER return - -check Amend and then add his info - - and send it out ASAP.

But - -it's been the tax year from - - you-know-where.

I think you just won the prize for tax return/situation of the year! But yeah, amended returns have to be mailed. I think if it was me (not much thought, mind you), I would seriously consider having her not pay the tax due and file the amended return showing no tax paid. The safer thing would be pay and get the refund and I would guess she had the money and was expecting to pay. Hey, there might even be some interest on this to make it all worthwhile!

Thanks guys - -I will send her a 1040X as a pdf file tomorrow - -showing NO $$ mailed with original - - -

Looking at only 30 more hours left till this season is officially OVER!!!

I filed an amended return showing no money sent with the originally e-filed return which had a balance due for a client a couple of years ago. It all worked out in the end, but be prepared for hate mail from the IRS wanting to know where the payment is until the amended return finally gets processed against the orignal return which took about 3 months in my case. Save yourself some heartache and let your client know right up front to expect correspondence.

Oh yes! A reverse annulment--ain't love sweet!

But, the Supreme Court, you say? What a paperwork nightmare. Speaking of which, don't file that amendment yet. Wait until the first one is fully processed. Well, you can hold off on the money if you need to. It will all get fixed in the end.

Meanwhile, don't forget to put the decedent on extension. You don't think that will mess up his Judgment Day, do you? I mean, maybe he's been camping outside the Pearly Gates waiting to see whether he was living in sin last year. And I'm pretty sure non-filers aren't allowed into Paradise.

Don't be too impressed. Here in New York, the "Supreme Court" is one of the lower levels in the state court herarchy. It is a court of original determination, not of appeals.

Are you LOVING the weather we have been having the past few weeks?

It's spring! The snow is all gone. The buoys are in the river. I've seen robins and kayaks. And I've only got two returns on extension. Life is good. :rolleyes:

Easter Sat - -there were people actually IN LAKE ERIE - -swimming - -at the beach in Hamburg (8 miles south of Buffalo) - -OK - -so it was 84 outside - -the lake is a brisk - -ummmmmmmm 38 degrees!

Actually saw my first sailboat out on the lake yesterday!!!

AND - - GO SABRES !!!!!
