terry Posted April 7, 2010 Report Posted April 7, 2010 T/P donated bushels of apples to local school which were grown on his property. Wanting to take FMV per bushel. This is a first for me! Pub 526 refers to food inventory but doesnt really relate to this situation. Thanks. Quote
Gail in Virginia Posted April 7, 2010 Report Posted April 7, 2010 I think that if he reports the FMV of the apples on his farm return as income (which is probably where any expenses of growing them such as fertilizer and pesticides should be), then he can deduct the FMV on his schedule A. That seems fair, doesn't it? Quote
PapaJoe Posted April 8, 2010 Report Posted April 8, 2010 Was the taxpayer in the business of farming? Quote
jainen Posted April 8, 2010 Report Posted April 8, 2010 >>Wanting to take FMV per bushel<< In my opinion, that is an appropriate deduction (assuming he complies with the rules for substantiation). Well, technically the lower of FMV or basis, but I would guess the reason he's giving them away is that he can't sell them. Quote

Lion EA Posted April 8, 2010 Report Posted April 8, 2010 Charitable contributions are lower of cost or FMV for unappreciated assets. Quote
