Client was sent to a temp job site 120 miles away from home. He did come home every night. His normal comute would be between 20 and 30 miles. Are these miles dedutable. Side point client is electrition, Union hall sent him.

i say no, he has so set work location - he goes from one contract job to another - but then again there is more to this senario than the question provided.

It seems obvious to me that he did not meet the overnight rule, so travel expenses are not deductible. He can only claim business-purpose miles, if any, after reaching the job site. By the way, in my observation 120 miles is a bit long, but certainly not uncommon for a daily commute.

Generally, the IRS will, when it's a worker working out of a Union hall going to different jobs, set a 35 mile limit. Inside, it's not deductible, outside, the extra mileage is.

He normally works in local area. BUT times are tight and workers are taking what they can get. I read in the U.S. Tax Guide that yes it is deductible be cause it was outside of TAX Home and Temporary. Job started August 25 2009 and Ended February 2010. Now he is back to working locally.
