I am getting an error on 1120S

I am preparing an 1120S for a MD corporation. The corporation was formed on 02-01-2009 and it became S corporation on the same date. When I try to efile (federal) I get an error that states "S election effective date must be equal or precede the tax period begin date"

If I enter a fiscal year from 02-01-2009 to 12-31-2009, I don't get any errors. Any help will be appreciated.
