jrollo Posted March 17, 2009 Report Posted March 17, 2009 Couple are separated (no legal separation from the court). Wife would like to file married filing separate. She will not have a refund nor will she owe anything. On the other hand, husband will owe a great deal to the IRS. if filed MFS. They have been separated for some time, and in past years agreed to file married filing joint. However this year the wife would like to file MFS Since there is not legal separation can the wife be held responsible for the amount the husband will owe IRS on his return? Thank you, Jeff Quote

Thank you, Jeff No, if she files MFS, she will not be responsible for what he owes IRS. Separated or not separated is irrelevant. They may even be living together in bliss. Except for all his debt, that is. Edit: Sorry, I type slow. Quote
