terry Posted March 11, 2009 Report Posted March 11, 2009 T/P unmarried, her child 19 lives at home. Fails qualifying child & qualifying relative tests. Not in school & has income. Is T/P still able to continue using HOH status? Think I'm confusing qualifying child & qualifying person rules. I thought I recall the law changing to prevent HOH for older children still at home. Thanks in advance! Quote
RoyDaleOne Posted March 11, 2009 Report Posted March 11, 2009 I think not not head of household, however, here is the link to the myriad of hoops to jump through. http://www.irs.gov/publications/p501/ar02....ublink100041887 See qualifying child and or qualifying relative. Quote
SUE A. Posted March 11, 2009 Report Posted March 11, 2009 NO, CHILD HAS TO BE A DEPENDANT ON THE PARENTS RETURN TO QUALIFY FOR HOH. SUE Quote
TAXBILLY Posted March 11, 2009 Report Posted March 11, 2009 Cannot be HOH in this case but child does not always have to be a dependent for one to qualify as head of household (custodial parent). taxbilly Quote
