His wife and children all have valid social security numbers, and the wife receives only social security disability. I know the general rules of ITIN means no EIC. David1980 Posted February 2, 2009 Report Posted February 2, 2009 Does the wife have a SSN? If he's married to a US Citizen he ought to be able to apply for an SSN. Then you could amend the return (and prior years) and get EIC. But until they both have SSN there's no EIC. Quote
