Taxpayer has an ITIN and receives a 1099 for labor. His wife and children all have valid social security numbers, and the wife receives only social security disability. I know the general rules of ITIN means no EIC. Is there anyway they can qualify in the scenario I've described? Thanks.

None at all! He'll have to have a valid SSN for work in order to qualify.

Does the wife have a SSN? If he's married to a US Citizen he ought to be able to apply for an SSN. Then you could amend the return (and prior years) and get EIC. But until they both have SSN there's no EIC.
