New client has 2 disabled adult children, which in prior years never claimed dependent care credit. 

She is a teacher, so only available when school is in session IMO.  They stay days at an organization for disabled. Medicaid, etc pay most of costs but she also pays some. 

Would it make a difference if she is required by facility to pay some, or just takes it upon herself to do so? I'm thinking along the lines of if they don't require it, the payments may be looked at as charitable donation rather than dependent care?

Both receive a few thousand in SSI, but that shouldn't make a difference, should it?

Even though they only work 8.5 months a year, 7 hours/day, teachers ridiculously claim their jobs are full time.  She might fight back if you only take 8.5 months of dependent care.  If a client takes a vacation day, but still puts their kids in daycare, do you not count that day?  If you'd take it for that client, why not for another client just because they get twice the vacation time as average?

I'm guessing the amounts billed are what qualifies for the dependent care credit and if someone pays the childcare center extra, the extra payments don't qualify.
