WITAXLADY Posted June 3, 2024 Report Posted June 3, 2024 Can taxes be filed that way? Federal is much better MFJ but WI MFJ - they owe!! Even with giving up the WI married couple credit - one only owes $43! Is that legal? Have searched before and not found an answer thx D/WI Quote
BrewOne Posted June 3, 2024 Report Posted June 3, 2024 https://www.revenue.wi.gov/DOR Publications/pb109.pdf appears to me there is no requirement to match Federal filing status, as long as you qualify for the status claimed. Quote
mcb39 Posted June 4, 2024 Report Posted June 4, 2024 You are almost certainly asking for a letter of explaination from Wisconsin as Federal pro forma is attached to WI return. I have clients already getting these for various reasons. Also, be sure to be aware that some credits and exclusions are not available to married individuals filing separate returns. Otherwise, I can't help you. I have never been aware of this type of situation. I cannot find any ruling that says you cannot file this way. 2 Quote
Lee B Posted June 4, 2024 Report Posted June 4, 2024 I would raise my fees due to the additional complications. Just because you can do it doesn't mean it's a good idea. 2 Quote

I used to file MFS Delaware for couples where one worked in Maryland and one worked in Delaware, but then I realized that the total state tax never changed, so I stopped. It was also quite a pain to do in ATX. 1 Quote
