TAXMAN Posted March 11, 2024 Report Posted March 11, 2024 TP retired from PD drawing pension. Wife retired from state (non pd) drawing pension. She pays to state, health insurance to cover her and husband. Even tho it is not coming directly from pension either his or her's can I use the pso for 3k? I did notice on state pay stub it shows them giving her a little health credit. Quote
kathyc2 Posted March 11, 2024 Report Posted March 11, 2024 Section 328 of Secure 2.0 removed the restriction that it needs to be paid directly from pension. Quote
Lee B Posted March 12, 2024 Report Posted March 12, 2024 The previous restriction required that the premiums be paid directly by the pension plan. The distribution for the premiums still need to come from the pension plan. Quote
TAXMAN Posted March 12, 2024 Author Report Posted March 12, 2024 TP gets pension for being retired police officer. SP gets pension for being retired from state. Premiums being paid from checking account where pensions go into. Does this make a difference? Quote
