However, his former wife died in 2021 - so he could also file mfj with her?? He does get back more money as 1 child and not QW as not been a year she has been deceased. So can he file MFJ with her deceased and he surviving spouse for 2021? D Quote
Lion EA Posted March 18, 2022 Report Posted March 18, 2022 No. He can no longer file with a former wife, dead or alive, once he marries a new wife. His 2021 filing status revolves around his status 31 December 2021. If he was married to new wife 31 December 2021, his choices are MFJ with new wife, MFS with her as spouse, and possibly H/H if he qualifies. (Are you really saying the newlyweds didn't cohabitate for at least one night during the last six months of 2021?!) 5 Quote

Pacun Posted March 18, 2022 Report Posted March 18, 2022 He could easily benefit for three years by filing MFJ, QW, QW but he was desperate to get married. He has only two choices now, married filing Jointly or separate with his new wife. 4 Quote
