taxgirl26 Posted March 30, 2021 Report Posted March 30, 2021 Client has taxes taken from Social Security from Spain. I am under the impression these taxes would be put on Sch A if applicable. Does anyone do international returns to know if she can file to get back any of these funds by filing a non resident return in Spain? Quote
Abby Normal Posted March 30, 2021 Report Posted March 30, 2021 Usually better to take the foreign tax credit. Also, use the FECWKST to report this income (I think). 3 Quote
FDNY Posted March 30, 2021 Report Posted March 30, 2021 Wouldn’t the Spanish SS be taxable if applicable like our SS, not sure what treaty says. What I do with Canadian OAS is treat it like US SS pursuant to the treaty 1 Quote
Catherine Posted March 31, 2021 Report Posted March 31, 2021 You HAVE to check the tax treaty. For most countries, it's ordinary income here - but not for all. Tax credit F 1116 almost always works better than Sch A. 1 Quote
B. Jani Posted March 31, 2021 Report Posted March 31, 2021 I am surprise to find out check mark within client info form for treaty. I was working on 1040 NR for student from India. On client info page, found a check mark with the code and when I click on it, it flow correctly to 1040 NR. Just check for your country if it pop up. I do know that US has treaty with India but looking for place to put on tax return. 1 Quote
