Dave T Posted January 22, 2020 Report Posted January 22, 2020 T/P's wife began working in church school part time in 2019. Approx. 10 hours per week in their cafeteria. School provides her with 1099-Misc. Non Employee Compensation. There are set hours. Work is supervised. Done at their facility obviously so seems to me she should have received a W-2 not 1099. I have done the taxes for one of the teachers there for a number of years and she receives a W-2 with SS withheld so I am a bit confused. Any thoughts? Thank you Dave T Quote
ILLMAS Posted January 22, 2020 Report Posted January 22, 2020 The person is an employee and unfortunately would be subject to SE taxes, can’t remember the form, but you can notify the IRS about the employer not treating employees as employees. Just let your client know they might be out of a job afterwards if they decide to become a whistleblower. 1 Quote
Medlin Software, Dennis Posted January 22, 2020 Report Posted January 22, 2020 Might not be out of a job due to the embarrassment factor. Unlikely the church would want it public they are cheating the teacher, or the governments. 1 Quote
