WITAXLADY Posted August 9, 2019 Report Posted August 9, 2019 hello - please need clarification so I did the guys taxes.. - a W-2 and rental, stationed over seas then he informs me I got married Dec 31! - so now MFJ, except they are working on a Visa... and we get her wages translated into US dollars... and now he says does it matter she has a daughter... I see that if the duaghter does not have an ITIN by Oct 15 - he cannot claim her? Did I do the spouse correct? Am I correct on the daughter? Thank you, Darlene Quote
Max W Posted August 9, 2019 Report Posted August 9, 2019 You can amend the return to include the child. In the SS/ITIN box, write Applied For. Then mail it to the ITIN center in Austin TX with the W-7 and supporting docs on top of the return. If the wife gets her visa in time, you can include her, too. That's the way we've done it in the past, and it has always worked. Very important to keep copies of all documents, and tracking information - we had one client where the W-7 folks sat on it and sat on it and sat on it and we had to get the Taxpayer Advocate office involved. Having tracking and delivery information saved the client from late-filing penalties! (TA office handled it all for us, once we got through to them. It was literally all sitting on someone's desk, untouched.) Quote
