ndtc Posted March 9, 2008 Report Posted March 9, 2008 I have filed a Federal 1040 married filing joint, but husband non resident of CA and wife resident of CA. Tried to file CA as maried filing seperate - over writing and substituting wife (resident) as taxpayer with over written SS # and spouse over written from federal. this does not work. Any ideas? jmallard Posted March 10, 2008 Report Posted March 10, 2008 Tom, I believe you have to file MFJ for California also. Use CA Form 540NR (Part-Year and Non-Resident). The CA NR Adjustments form is where you can show the residence of husband and spouse. The husband may be a non-resident, however, all income earned while in CA is taxed. Jerry Quote
