schirallicpa Posted March 29, 2016 Report Posted March 29, 2016 Client is a new corp. Didn't realize she had a March 15 deadline.(calander year). Now if I file a sub s election with the 1120, will the IRS even consider it since we missed a filing deadline? Quote
BHoffman Posted March 29, 2016 Report Posted March 29, 2016 See Rev. Proc. 2013-30: https://www.irs.gov/Businesses/Small-Businesses-&-Self-Employed/Late-Election-Relief Don't forget to note "reasonable cause". I always blame the attorney. 3 Quote
schirallicpa Posted March 30, 2016 Author Report Posted March 30, 2016 I know that I can submit the s election late. (And of course you blame the attorney!) but the return wasn't filed on time to begin with. that's where I'm wonder if it will fly. Quote
BHoffman Posted March 30, 2016 Report Posted March 30, 2016 I think it will. I've filed the late 2553 with a late filed 1120S last year. Everything return was accepted, and the client got the penalty letter. I used the First Time abatement request over the phone and that worked. Get your POA up front because you will need it, and let the client know that a penalty letter will probably be coming and that they need to give that to you ASAP. Quote
