She cannot claim him as a dependent nor does he does not meet the age requirement to qualify her for HOH -- Unless he is permanently & totally disabled. No EIC.

If both income and support tests are passed, would son not be qualifying relative?

I am waiting for peer review but AGE is not a requirement for claiming someone as a dependent. I am 100% sure that the person can be claimed as a dependent. I am not 100% sure about the household status.

He is not a qualifying CHILD but IS a qualifying RELATIVE for both exemption and HOH.

When I was reading the question, I wasn't thinking relative but only as the "child" in relationship to the question.

Thanks to all....this is one of those things i know, but over-think and confuse myself....I had the return all done (with dependency exemption and HOH) then started to re-think and question myself....I need more coffee and/or more sleep.
