Janitor Bob Posted February 26, 2008 Report Posted February 26, 2008 34-year old son lives with my client all year....No income, not disabled....client (mother) pays all expenses. Can mom claim son as dependent? HOH? Quote
Chrisbry Posted February 26, 2008 Report Posted February 26, 2008 She cannot claim him as a dependent nor does he does not meet the age requirement to qualify her for HOH -- Unless he is permanently & totally disabled. No EIC. Quote
Chrisbry Posted February 26, 2008 Report Posted February 26, 2008 I stand corrected -- she can take the exemption based on QUALIFYING relative. See the definition of Qualifying child on Page 1-9 of 1040 Express Answers Quote

Pacun Posted February 26, 2008 Report Posted February 26, 2008 I am waiting for peer review but AGE is not a requirement for claiming someone as a dependent. I am 100% sure that the person can be claimed as a dependent. I am not 100% sure about the household status. Quote
Chrisbry Posted February 26, 2008 Report Posted February 26, 2008 He is not a qualifying CHILD but IS a qualifying RELATIVE for both exemption and HOH. When I was reading the question, I wasn't thinking relative but only as the "child" in relationship to the question. Quote

Thanks to all....this is one of those things i know, but over-think and confuse myself....I had the return all done (with dependency exemption and HOH) then started to re-think and question myself....I need more coffee and/or more sleep.
