Randall Posted March 4, 2015 Report Posted March 4, 2015 Form 8839 instructions say if info not available on line one, leave blank. My client has adopted child birthdate of Jan 2015. ATX won't accept a date after 2014. Also, no ssn or atin yet. When I leave these blank per instructions, ATX won't accept this and efile can't be created. Does this mean I have to paper file the return? Quote
Jack from Ohio Posted March 5, 2015 Report Posted March 5, 2015 Any adoption credit information will go on the 2015 tax return. Hence the reason ATX will not allow dates later than 2014. Quote
Randall Posted March 5, 2015 Author Report Posted March 5, 2015 Jack, I understood that expenses paid in 2013 could be used for the credit in 2014 even if adoption is not finalized until 2015. Quote
Jack from Ohio Posted March 5, 2015 Report Posted March 5, 2015 Jack, I understood that expenses paid in 2013 could be used for the credit in 2014 even if adoption is not finalized until 2015. That is incorrect. Expenses can only be claimed in the year the adoption is finalized. Quote
Lion EA Posted March 5, 2015 Report Posted March 5, 2015 From TTB: When to Claim Credit and Exclusion Domestic Adoption Expenses paid by taxpayer in... Then take the credit in... Any year before the year the adoption becomes final. The year after the year of the payment. The year the adoption becomes final. The year the adoption becomes final. Any year after the year the adoption becomes final. The year of the payment. TTB refers to IRC 23 Quote
Randall Posted March 5, 2015 Author Report Posted March 5, 2015 Lion EA, this was the way I was reading it too. The worksheets even have lines available for credits taken in previous years. My problem with ATX is that it won't let me leave info blank as the instructions say to do if that info is not available. So I was wondering if I have to paper file this return. Quote
Lion EA Posted March 5, 2015 Report Posted March 5, 2015 (edited) Don't use ATX, so can't answer that part of it. Is 0 an option? Is there an N/A option? Edited March 5, 2015 by Lion EA Quote
kcjenkins Posted March 5, 2015 Report Posted March 5, 2015 I think you do have to paper file in that situation. Quote
rfassett Posted March 5, 2015 Report Posted March 5, 2015 I agree with KC. I just did one today but had all of the info so ATX was pleased with it and let me create the e-file. 2013 expenses for baby adopted in 2014 and pending final approval in 2015. On a personal note, I am an adoptive parent and that period between placement and finalization is the most stressful, mind numbing, slow moving time in a person's life. Tax season is a walk in the park compared to that. I oft said that if there would ever be a change that would require my wife and I returning the child, they (whoever they would be) would never find the three of us - and I meant that. Fortunately it did not come to that. And we lived happily ever after. Anyway - it seems paper filing may be your only option. 2 Quote
kcjenkins Posted March 6, 2015 Report Posted March 6, 2015 Bless you for that. As an adopted child, I never considered anyone but the people who loved me and disciplined me and raised me to be my 'real' parents. I am sicked any time I read of a child "returned by the court" to those who either 'gave them up' or did not stick around to know about the adoption till much later. 3 Quote
Randall Posted March 6, 2015 Author Report Posted March 6, 2015 Looks like I'll have to paper file. I think Jack must have been thinking of a foreign child, must wait until finalized in that case. Quote
