Husband adopts children from wife's previous marriage.

The wife has asked me if that qualifies as adoption credit. I told her I didn't think so since the 2 kids were already his dependents and he's been claiming them. Of course, she's NOT my client.

One HRB place told her she couldn't. She went to another HRB and they told her she could. Imagine that!

Expenses to adopt a spouse's child are not qualified adoption expenses therefore the cost of her husband adopting her children would not qualify for the adoption credit. It states it clearly in the form 8839 instructions.

Thanks Ann. Usually I direct my "non client" friends to the IRS forms & website for answers -- especially when I'm at home and all my research material is at the office.

I've never had to deal with an adoption credit and it's not likely I ever will.
