latoya22 Posted February 7, 2008 Report Posted February 7, 2008 I have a client who married last year (Resident of Georgia) and his wife moved to Georgia from Michigan in August. She has income from Michigan and did not work in Georgia. We are filing MFJ. ATX is my software provider. My question: I have to file a Michigan return as a part-year resident for the spouse. However, the ATX software will not let me efile the return because I only have the spouse's length of residency completed. The husband never lived in Michigan. Since we are filing MFJ both appear on the Michigan form. Any ideas??? Quote

Booger Posted February 7, 2008 Report Posted February 7, 2008 How about checking Part-Year Resident for both, then reducing the combined income by the amount not taxed by Michigan? What you should end up with is the wife's income earned in Michigan. Just a thought. Booger Quote
Lion EA Posted February 8, 2008 Report Posted February 8, 2008 Some states require MFS for state even if MFJ for fed when one of the spouses is not a resident for essentially the same amount of time as the other -- a case like yours where they were residents of separate states before marrying and one of them moving to the other state. Check the state instructions for both states involved. Quote
