jklcpa Posted February 4, 2008 Report Posted February 4, 2008 You can't go by whether the entity has a Fed Id # vs SSN, Even an individual operating as sole prop should have a FEIN if they have employees, using the FEIN to file payroll returns & W-2s. The Schedule C has a place for the FEIN. Go back & find out if the sub is an unincorporated entity. Quote

Send the W9 and ask the question. If they don't answer, send the 1099. If they are a corp, they will just ignore it. Tom Lodi, CA Quote
