ljwalters Posted March 31, 2013 Report Posted March 31, 2013 Clients are 68 and 63. (one is under 65) for questin step 4 question 3 of eic questions. MFJ / one gets SS the other get SS disability. Total AGI 5,632. Total SS income not showing up in AGI 24,365. Program says YES to EIC. I,m Not sure. Do they Qualify or not. Quote
Guest Taxed Posted March 31, 2013 Report Posted March 31, 2013 They need earned income. Where is that source (can't be SS)?? I don't think they qualify because no earned income?? Quote
jklcpa Posted March 31, 2013 Report Posted March 31, 2013 One being under 65 would be ok, but they don't have earned income. SS disability is considered pension once a person reaches the minimum retirement age, and SSI isn't earned income for the EIC. I don't think they qualify, but I'm no expert. Some other members here have a lot of experience with the EIC. Do you have their birthdates entered? Maybe the program is allowing it because it thinks the one getting the SS disability is under 62? mcb39 Posted March 31, 2013 Report Posted March 31, 2013 Where is the AGI coming from? Did one of them work part-time? Disability would not be showing up in the AGI as that would be included in the SS. If one of them worked, they do qualify for EIC. Quote
ljwalters Posted March 31, 2013 Author Report Posted March 31, 2013 Thanks for all your help. Yes the AGI was of course from earned income. W-2 from their Scorp of 6000 and 200 plus from part time job wife can't do any more. then lowered from 200 loss from k-1 of their scorp. Quote
