Does anyone have any experience with or have you had any luck with filing the couple as married filing joint with the innocent spouse form and the taxpayer still receiving their full refund? Quote

Max W Posted February 13, 2013 Report Posted February 13, 2013 You should be using Injured Spouse, not innocent spouse. Client is 'injured' because refund will be offset to pay student loan which is not his. Quote
GeneInAlabama Posted February 13, 2013 Report Posted February 13, 2013 I have one where I file the injured spouse on every year and he always gets his full refund, but all the refund is due to tax he has paid in. If the other spouse has a refund due, the IRS will take it. Quote
