Margaret CPA in OH Posted February 8, 2013 Report Posted February 8, 2013 I am baffled by this worksheet as it says (#4) if the student has claimed the American Opportunity Credit for any of the 4 prior years they are no longer eligible and must take Lifetime Learning Credit. But if 2011 year was the first year claimed and ARRA extended it through 2012 (per IRS website), why cannot the student take it for 2012? I must be missing something, I guess, but this doesn't seem right at all. Quote
Tax Prep by Deb Posted February 8, 2013 Report Posted February 8, 2013 I agree. I think they made a mistake in the wording. Way to vague and not the intended result. Deb! Quote
Margaret CPA in OH Posted February 8, 2013 Author Report Posted February 8, 2013 So what to do when the student qualifies but software calculates no? Time to play around, I guess. Quote
JMovichEA Posted February 8, 2013 Report Posted February 8, 2013 Not any of the 4 prior years, "any 4 prior tax years". Not very well worded, but that's taken from the 8863. Quote

Yes, I read it is if they took it ANY 4 years ( total of 4 years) they are not eligible. Anything less than any 4 years they are eligible. Quote
Guest Taxed Posted February 8, 2013 Report Posted February 8, 2013 I already sent an e-mail to CCH about this. Still waiting for a response. It appears their CS is overwhelmed to say the least! For Now just click No to that question and AOC will be calculated correctly. Quote
