Thanks for your replies. She is a non registered alien (Mexico), I will be filling out a W-7 for her. She stated that the reason she wants to file is that she will be applying for citizenship and I guess that helps their situation in applying. It sounds like I will report her income as self employed since no W-2 and she has proof (I think from her boss) of the amount. But I am still unsure now if I should file a 1040NR or a 1040. Any other comments? Larry

I have never done one before, so please bear with me. One question for now--this t/p is an alien that worked and got paid cash. Would I report this income as self employed, or can I put it on line 7 for wages ? Probably will have other question later on. Told t/p to come on Friday to give me a chance to read the form instructions. Any reply to this question is appreciated. Thanks, Larry

I thought I read somewhere that a computer that a student purchases for school is this year a qualified ed. exp. for the Opportunity Credit. I cant find any such thing now. Is it an expense, or is it my wishful thinking and not a qualified ed. exp.? If it is, where can I find this reference. Thanks for your replies, Larry

Actually, now I have another quesion- If he files mfj, then how do I get the Sch M to reflect only 400 instead of 800? My understandingm is that you need to have a SSN to qualify. Do I override amount on form?

For me, this is a new situation-- Tp is married to an alien wife (from Mexico). He is a citizen of U.S. w/ SSN. They have a daughter, not a citizen. Has ITINs for both wife and daughter. He completely supports his wife and daughter. Wife does n ot work. According to what I have read, his wife and daughter qualify as dependents because she has no income and Tp supports them 100% while they live in Mex. and he lives here. I was filing him with status mfs, putting her ID# in spouse ssn and also putting her down as a dependent. When I try to create efile, it wont let me saying that the spouse and dependent social #s cant be the same. Since he is filing mfs, her ID# has to be included on top, and since she is also his dependent, her ID# is also in this section. So my question is, how can I create efile, or if I cant, do I mail this return? Maybe this is the wrong filing ststus to file. Does anyone have any suggestions? Any help would be appreciated. Thats why I posted the question. Anyway. father gets about 11,000 from a pension (taxable). Mother earned 11,000 in job. I didnt read anything about community prop. Would that be a factor? Larry

Taxpayer lives with parents and sister and brother. Taxpayer has 16,000 in AGI. Parents have 22,000 AGI. Sister was a student in 2009 age 21. Taxpayer is age 31. Question: Can brother claim sister for EITC? I would think that he could because according to the tie-breaker rules, since sister's parents choose not to claim her (sister), Taxpayer's AGI is higher than half of parents AGI on joint return. Am I thinking correct? Any feedback would help. Thanks, Larry

Look at page SE-3 on innstructions, under Income and Losses Not included in Net Earnings From Self Employment. This is what I have done for years on my return, so it is correct. So why is it being rejected this year when I efile my return (reject error on 1st post)from agency? I still want to beleive that this is ATX software problem, but I am not a tech. guy so I may be wrong. Can anyone tell me how to correct this? Thanks, Larry

I've efiled twice now and got the same rejection on my return: >>1040D35 Field Sequence Number At least one or more numbers are invalid or out of order. Form SCH SE1040 Occurrence: 1 Seq: 60 The Field Sequence Numbers within each record must be in ascending order and must be valid for that record.<< I put in my notary fees by bunny jump on line 3 and entering amount on line 4 in worksheet. It subtracted right on Sch SE and amount is shown on dotted line - so what am I doing wrong? Every year, Ive done it this way. Is it maybe a glitch in the software? If anyone knows of a fix, please respond. Thanks. Larry

A tp is taking an online course that is offered by a university. He is taking this course to better himself for advancement in his work. He pays in a payment plan offered by the school ($1000.00) in 2009. The total to pay is for tuition and the cost of books. Is he able to take the Opportunity Credit for this? I'm just not sure about online courses. Or maybe, he can use the tuition deduction instead? Any comments? Thanks, Larry

didnt know the ATX 1040 had unlimited efiling. Ive had 1040 program since I started with ATX, and Im paying 3.00 per transmission. By the way--all the forms (except a few) are ready for efile. Larry

A potential client came in and asked me if she can caim her disabled son now that she works parttime and earns about 7000 in income and 6400 in SS. Son is totaly disabled and only receives SS and SSI benefits. My question to you all: If he uses all his SS benefits for his use, is it "his own support?" So in calculating if he provides over 1/2 of his own support, would this be part of it?

The billing rates I charge per form are not calculating in the invoice. I checked the options tab and everything is correct. Can anybody suggest what I am doing wrong? Larry :scratch_head:
