  3. @cbsleeI hear you. But we all know that Congressional intent and IRS/Tax Court interpretations do not always match up. For an example, Congress vehemently argued that the ACA Shared Responsibility payment was not a tax, until the 9 clowns in black gowns said it was. I think I have an obligation to my clients to tell them that the guidance is not clear, and that there is a chance that the deduction will be challenged by IRS. For those clients who are risk averse, they may not want to roll the dice. If they choose not to take that position, and guidance comes down that makes it clear they should have, we can amend. For those clients who want to take the position, I will do so. If the return is challenged, I will defend the position at audit. It is ultimately the client who is responsible for the position taken on the return. Tom Modesto, CA
  4. I think it is a risky position to take. I think I will lay it out for my clients and allow them to make the choice. ATX has not put the QBI form out yet, so I am anxious to see how this is going to work from an input standpoint. I don't know if there is a way to designate that an activity is qualified or not, but it seems to me that there should be a check box or something on the input forms that allow you to say it is or is not QBI.   7. It is not that Max. My client is also under an installment agreement. As soon as the IRS OIC office gets the paperwork, the Installment Agreement department gets notified and everything stops, including my client's payments on the IA (because they are now making payments on the OIC). If the OIC people don't tell the IA people, the IA people may default the IA for failure to make payments. And of course the client cannot afford to make both the OIC and IA payments. Tom Modesto, CA

  11. Terry, Yes, the client would file a non-resident CA return. You will know right away from the W2 if the employer withheld correctly. There should be withholding for CA SDI and CA PIT on the W2. If not, the employer is not treating the client as an employee working in the state. Tom Modesto, CA
  12. Now that I think about this, I would not touch it. If that offer goes into default, and you agree to prepare the 2017 return late....man, I don't know if they can get to your E&O, probably not...but I would not chance it. Let the guy who took on the engagement for 2017 have his E&O hanging in the wind. He knew or should have known that they needed to complete the returns to keep the offer in effect. That is negligence on his part. You have a clean break from the client. Don't muddy the waters by getting back into it. I change my stance and I would definitely do the Jack mantra "Run Forrest Run!". Tom Modesto, CA
  13. @Terry DOne of the requirements of the offer is that all tax returns must be filed for the next 5 years or the acceptance can be withdrawn. I assume you have POA for these clients. You better get with the Service quickly to stave off a default. They may have messed this up big time. Tom Modesto, CA

  15. Sometimes, these situations turn out to be the best for you in the long run. I have had a couple of clients leave me over price. When they get what they paid for, they come back and never leave again and never complain about the price. On the other hand, if the client is a sleaze bucket....do you really want to deal with them again. I have no problem taking back a client when they come back after shopping and decide I still provide value and service they are looking for. Tom Modesto, CA

  17. Can't help you with Illinois, but I have a client who is domiciled in CA, lives and works in China. Every year we file a CA return because CA does not conform to Foreign Income Exclusion and CA taxes worldwide income earned by domiciled residents of the state. $0 Federal Tax.   18. Just an update, yes they are that good. Fresno State finally, for the first time since the blue turf was installed in 1984, won a game at Boise State and won the Mountain West Conference Championship. Ranked 21st in the final CFP poll.   20. My Rep, Will Van Kleef, again told me that the MAX software will have the W2 and 1099 programs rolled into it. He said I was to use both my install codes when I download the program and I will get all my 1099 and Payroll forms loaded into Max. He did say wait for about a week before trying to roll over returns from the PR program because they don't have all the forms ready yet. So, I renewed today.   23. Max, Thanks for your response. So what happens if the offer is rejected? The Installment agreement has a time 2 year review period. Is that date pushed out for the period of time that the offer was under consideration? Tom Modesto, CA
  24. Client has an installment agreement in place with the IRS. Is going to file an offer. Do they need to keep making payments on the installment agreement while the offer is being considered? I know that collection activity stops during the offer consideration period. Does the installment agreement stop as well, and then pick right back up if the offer is declined? Thanks in advance.
