Correction; gain or loss is on 4797.

ATX used to rollover the amount of the state refund into a new 1099-G, so the old one(s) were lurking with no amounts in them, and the new ones didn't have the address or other info, just the amount. So I was always deleting excess 1099-Gs.

The difference is whether it's recourse or nonrecourse debt. If you use the debt as the selling price, some of the income is going to be counted twice; as COD and as gain. At least that's the way I see it. I'm a bit too tired right now to work out the numbers.

I've had no issues with the IRS not finding the numbers in past years. The issues were more with the IRS saying you can't file with 2 people's income on one return. Our practitioner's liasion was working directly between the service center and us and even pulling specific returns from exam so notices wouldn't go out in the last two years. Remember in the past, there was no way to coordinate the two returns, except through our own attached spreadsheets. Using line 21 allows the wages to match the W-2, etc. I'm currently using a hybrid of the forms, which is allowing me to finally efile. On my LGBT tax listserve, preparers are trying various methods to determine how best to file. That this isn't settled is evidenced by the focus groups the IRS are conducting in late February and early March to get in 4 cities to get input from practitioners that prepare at least 10 RDP returns. The form 8958 is a direct result of our problems with filing and the IRS is working within the community to determine what both the service centers and the practitioners need to best serve our clients.

Really? Maybe I should download it. Except Kimmi on the official site said the changes in 12.9 will be incorporated into 12.10, so there's no real hurry.

Yes, but for rentals, it's net rental income, not gross. Won on an audit with that too, by going through the EIC investment income worksheet & instructions.

Margaret, just because the foreclosure has occured, doesn't mean the lender has actually cancelled the debt yet, especially since it was recourse. Some lenders have been attempting to collect from debtors, especially if they have other assets. And often it can take months or even years for the lender to write off the debt. Since the foreclosure is late in 2012, you most likely have a split in the two transactions. The 'sale' portion has occured, and is reported on the 4797, and likely he has a loss, depending on his basis. The amount left on the loan is considered the selling price. Dave Fogel has some of the best info on his site regarding COD & foreclosures. I'm not in CT, so I didn't know where. Just that a lot of states aren't mailing the durn things anymore. Pain in the butt if you ask me, especially if you're out of state.

You don't need 12.9 unless 12.8 is causing you to crash, etc. 12.8 has been fine for me, so I don't need 12.9. So far. Just make sure you download & save 12.8 from the website with ATX closed, run, reboot computer, open the program.

I do renew either early or at least early enough to get the disk when it first is available so that I can play around in the software with my own return and get used to whatever changes are in there. Due to our lovely Congress, there has been only ONE year in which the program was pretty much completely up and running on the initial disk-that was when Congress & Obama extended everything for two years, so the second year (was it 2011) didn't have any changes. Every other year has been either more or less of a cluster depending on when the extenders were agreed upon and how many forms have been affected. Each year it seems to be worse. This year, the IRS couldn't even have a 1040 ready; they've learned as well to put off finalizing forms until Congress has finished dickering. So it's kind of a perfect storm for us; between Congress, the IRS, and ATX revamping the program it's the tax season from hell. And I've got sympathy for everyone affected except for Congress.

I've never edited the letters (except when the 1040X letter wasn't available back a few years ago), so I just switched the font, and am good to go. BTW, 12.8 did fix the issue with the state letters not saying efiled until you opened the state letter.

IRS issue. You just have to wait until it is approved.

Try deleting form 4562 from the 'assets' folder. the complete instructions to do this are posted somewhere on this board and on the other board. If you know which form may be corrupted, you can just delete and reinstall that one form, not all of the forms, which takes much less time. There's a post on the other board from someone who tried this with form 1065 and had sucess.
