  3. When I started the beta, the ATX person I worked with said that they had actually shut off peer-to-peer because of different businesses 'sharing' software. In other words, two or three separate businesses would buy only one copy. He said they realized that shutting down the option wasn't going to work and it would be available for 2013. In setup, there was a peer-to-peer option, but since my network isn't set up yet, I couldn't test it. My assistant's girlfriend is a professional network whiz, and will set it up after 10/15...also giving my assistant the option to work remotely from the Bay Area where said girlfriend lives and my assistant wants to move. She's so valuable, I don't want to lose her!
  4. Yup, good work! The CP2000 includes any of the items that were reported to the IRS, but not on the tax return (or in the case of mortgage interest, a deduction shown but no 1098 received). Fixing the CP2000 issue doesn't mean the return wont be selected for a full audit of say a Sch. C, but all of the AUR items should have been fixed and no more notices will be issued.
  5. Jack, did you test in a network environment? If so, I'd be interested in how that went, and what type of network you tested. I'm setting up a peer-to-peer most likely. I was told that option was going to be available again for 2013.
  6. It's not going to reference the earlier one, and the AUR number will be different. Apparently they have read your correspondence, and the only open issue is now whatever other issues might have been on the CP2000 that didn't go away with the 1099-R issue. Are you saying the bill is now $4? Or there is additional tax due of $105 & interest of $4?
  7. She'd be better off trying to pay off some of the taxes due, rather than the penalty. That is the advice I'd give. And make sure the payments are marked to be applied to the trust fund taxes first. I don't know why you are so concerned about the TCP over any of the taxes due.

    If the automated notices are going out, but correspondence isn't being reviewed, what about the 30 day deadlines for correspondence? I see a bunch of NOD's in the future...
  9. Maybe if she had taken CPE she would have known her arguments wouldn't fly.....and might have improved her record keeping...
  10. That'd get you a day-long update, 2 hours of ethics and leave you 5 hours for other subjects. Yes, barely a minimum.
  11. My CPE is required, but I often get way more than my 80 hours every two years. I think my last cycle had 120 or more hours. I pick up additional classes if I need something specific, like the FATCA stuff, and will do a webinar on amending SSMC returns just to make sure I have covered all the bases. This year a week long seminar I'm attending has a two day class on biz tax & update that I'm looking forward to since most of my updates in the last few years have not had much of an entity focus and I'm starting to do more partnerships & S-corps. Continuing education is a requirement in our chosen field and I can't believe the backlash I saw against 15 hours required.
  12. "Probably" is too soft a term. The IRS WILL look at all of her personal assets, including compensation for recovery of the trust fund taxes. After all is said and done, getting an OIC for the other penalties & interest is a possibility.
  13. There seems to be some confusion on the trust fund penalty and the actual trust fund taxes. The trust fund tax, that she withheld from employee's paychecks and didn't pay, should be negotiated to be paid first. The TCP is just another penalty. The TAXES need to be paid. Then the employer portion of the taxes. The easiest part to OIC will be the penalties & interest. The trust fund taxes will attach to any responsible party, including ANYONE that had control over whether the taxes were paid or not.

I'm going through the exchange, and don't qualify for any subsidies or credits (unless I opt to insure my employee, which I can't afford right now & besides she'll qualify for Medi-Cal under the new law). I'm excited that I will be able to BUY insurance at a much less cost than the former high-risk pool.
  15. Anything involving health care falls under HIPPA. They'll be under the same restrictions as all your doctors office employees.
  16. KC, sexuality is a spectrum from 100% hetero to 100% homo, with many people falling in between (see the Kinsey studies). Someone who is 95% hetero (actually bi) may never act on homosexual impulses or simply not meet many if any people that 'spark' them. For instance, a male friend of mine at Burning Man has never had a homosexual relationship, but totally sparked on a man at another camp. He kept on saying, "what is it about him, he is so frikkin hot!". He's bi on the 'more hetero than not' spectrum. Some bisexuals are totally 50/50; equally attracted to both sexes. Bisexuals usually describe it as "it's the person, not the gender". In the face of discrimination, bisexuals tend to have it a bit easier in that we can 'pass' by not expressing the gay side.
  17. When I had Aflac with an employer, the payments were post-tax. Check the taxpayers paystubs to be sure.

  20. Maybe turbotax can't efile 2011 returns, but I've been filing them all throughout this season. They just have to be MEF compliant. Less forms were available in ATX 2011 than in 2012, but the 2555 isn't one of them. Now some of the other software out there may not be able to efile 2011, but ATX can. Some other providers were MEF compliant for 2010 too.
  21. I'm finding a lot of my Registered Domestic Partners have already gotten married! As far as amending, I've had a few who I've been filing protective claims for that I already know will amend. Others that got married out of state in the interim have indicated they'd like to amend or at least see if its beneficial. Some who benefited greatly from splitting their wages know they won't amend. We made sure they filed before June just to make sure they got filed before any changes occurred. I'm teaching a class on this tomorrow night; changes to state issues are coming in fast & furious! I'd be grateful for any links like the Huff post one on the other thread that gives any guidance to what's occurring on th state level.
  22. If you read the article, the Ohio suit is to recognize the marriage. It was a separate case in PA that was about estate tax. At last heard, both VA & Utah have said to file same as federal unless the state laws are changed. MD has same sex marriage.
  23. Why can he not efile 2011? I had no issues efiling for a client that worked out of the US.
  24. The overthrow of DOMA simply means that the federal government recognizes same sex marriages. Yes, the couples have to actually get married to get the benefits, same as hetero couples.
  25. Jack saying he's 90% ready to stay is saying a lot. We know how much he beat up on ATX last year and the issues he had. I'm relying on him to let me know the network is working, since mine still isn't set up. But should be for tax season. Better be for tax season!
