If you've already carried back the losses, you'd roll over the amended return and then the problem is solved. The correct NOL will roll forward & show up on line 21. Then do the worksheet, and the correct carry forward will go towards next year.

KS has a worksheet you fill out but don't file....weird, but whatever. Available here: http://www.ksrevenue.org/pdf/iiallocation13.pdf MO allows SSMCs to file joint returns even though they don't recognize the marriage. After the RTRP suit, I think NY has moved to require more than a simple registration fee for tax preparers, but I'm not sure on this. There were quite a few states that were moving towards some kind of licensing when the RTRP started, and thus suspended their programs. I suspect we'll see some of those states move forward on requiring some level of registration and competency testing. -
The husband does NOT always go 'on top'. I have several clients where the wife is the primary earner, or when they married (both were clients) I rolled over the wife's return because it was the most complicated and added him to it as spouse. Having husband as taxpayer is just a throwback to the old days when wives rarely worked and were property.

It depends on the state. At least some of the states want to see the federal proforma that was used to create the state return. CA put on a checkbox that says the state filing status is different than federal, and I've seen at least a few others that have some indication that the return is an SSMC. Most have created some sort of form for SSMCs. What state/states are you trying to file? -
You have to choose home office as the type of asset. Are you doing that?

Tom, there was no indication that a trust is in play, just the estate. It gets confusing because they both file 1041s.

If I can actually get up enough energy to put pre-washed greens into a bowl and put some dressing on them, I'm ahead of the game. Unfortunately my big salad bowl has to be washed to do that. Dishes only get done when I'm out of space in the sink. -
The add needed forms automatically is whacked now. I get Sch A every time someone has state withholding, the 8960 when people are nowhere near the income level to be affected. And worse, the damn forms don't stay deleted! I had to print a return three times because of a 1099-G that kept rolling over the prior years state refund and putting it in as taxable when the previous year had been filed late so the refund wasn't taxable in the next year, but the one after. Delete, save, hit print...oh crap, there goes another ream of paper before I noticed (I'm too tired for this crap!). The Sch A wouldn't be an issue except that I use the forms billing and it screws up the invoice.

I got an email from a client that asked for a new copy of her 2010 amended return since her cat spilled juice on it before she got it mailed. There were 2 amended files in the program, one for federal, one for state. I asked my assistant to prepare & put a new copy up in the portal. So I get a call from the client asking why the new copy had a different refund from the new one. Sure enough, the wrong one was up there. And this client I had mistakenly double-booked their pick up time. And they had very nicely brought a 4-pack of RockStars as a gift at the time. Another one yesterday, I hadn't checked on the invoice the method of billing. So I handed them a bill that said zero fee. That's an error I don't often make!

Before there was PDF, the 8453 was necessary. Now it's just an option. I don't know of a requirement for the appraisal to have a wet signature. If the IRS wants the original, they can ask for it.

Was the custodian Pershing? One of the forums I'm on on Linked in has this same question; the code should be Q, not T. If the client is 75, I'll assume the account was open at least 5 years? The poster on linked said Pershing told her 'they always use code T'. Which is horsehockey for the broker if the account has been with that broker for at least 5 years.

You can nominee accounts for which she was the primary owner. and you said there were other accounts which you ignored which were joint accounts? And the daycare? Happens when there's more than one kid and one bill...some places don't separate it out. Trick is to bill for this stuff. I prefer emails too, but if someone wants to talk about the return, then that's just part of the service I provide. I think it's really too late to tell someone to go somewhere else, especially if they've given you the info, and you're just not clicking. -
8453 doesn't get transmitted. You mail it in with the docs.

Thank you Joel. That's what I had to do for the royalty interest too. I'm particularly brain dead today. New client cancelled for the second time....by phone at noon, when I was being awakened at 1pm especially for that appointment. I didn't check my phone messages until I went to call him at 2:20 to find out why he didn't show. Not getting another appt. until after April 15. And he begged for a consult before then.

I've got the K1 I was bitching about on another thread. All done, but for the depletion deduction for working interest depletion. The royalty interest depletion goes on Sch E pg 1 ( and I had to start a new record since there's no way to get it to flow from the K1 to the actual record where the royalty income is reported since that line on the K1 isn't linked, and no overrides on the form....) But, can't find anywhere to report the working interest depletion. Ordinary income is reported on Sch E pg. 2. I think in the last two years I used an override on the E pg. 2. Any ideas on a. How to do this in tax, and where the $&@* depletion is supposed to go? I believe working interests generally go on a Sch C, but this is a PTP. I'm about to just use line 21, but thought I'd come here for ideas first.
