You don't account for it. Its an early withdrawal. Period. He just gets the cash, doesn't get out of tax and penalty.

Rebooted my machine, & went down for a nap during the reboot, then it was time for my massage, then got groceries and when I got back 5 or 6 hours later, they went off fine. Not supposed to use computer directly after massage, and I always listen to my masseuse. Yes, Nicole I have my shoulders back & my chin down!!!

Is anyone having problems sending efiles? I've tried sending them three times; each time got interrupted by arriving clients, and when I come back the program is frozen with it stuck on 'connecting to efile center'. The first time my internet had gone down, but now, as you can see, my internet is fine, but the EFC wont' answer. Any ideas?

My boss at work was going through a return for hours trying to figure it out. They had a lot of qualified dividends; all their income was dividends. No tax. -
Try syching with ATX. I got my acceptance within a few days on a 1099.

she needs to keep track of basis. its easy in ATX if you do the p'ship return, but that info is not always included w/the K-1. UPE are a deduction on the Sch E pg 2. She should have that the van expenses if paid by her are UPE in the partnership agreement.

my roommates each have one W-2, and one got a tiny bit of EIC and the other has an IRA contribution (good girl! she's only 21 and started the IRA at 19). They get done really fast, really early. My ex husband gets a work up and an extension (and this year he has about 6 more rentals and a resident alien wife with no ITIN; told him not to hold his breath waiting for the refund!)

Just to reinforce what i posted earlier Governor Palin must include per diem reimbursements on Form W-2 Governor Sarah Palin Press Release No. 09-35, 2/23/09 Governor Sarah Palin (R-Ala.) has received amended 2007 and 2008 W-2 forms that include an additional $8,500 in income each year from per diem reimbursements that should have been subject to taxation. A per diem allowance is an alternative to reimbursing employees for their actual substantiated expenses for away-from-home lodging, and meals and incidental expenses. The per diem rate may not exceed the rate paid by the federal government to its workers on travel status. The rate varies by locality of travel. If employees provide simplified substantiation (time, place, and business purpose), the per diem reimbursement isn't subject to income or payroll tax withholding and isn't reported on the employee's Form W-2. Alaska provides a $60 tax-free per diem reimbursement to state employees to cover meals and incidental expenses they incur while traveling away from home on state business. The state had considered Juneau, the state capital, to be Palin's tax home. However, Palin had billed the state for 312 nights she spent traveling from her Wasilla home to state offices in Anchorage. Juneau is approximately 600 miles from Wasilla. Wasilla is approximately 43 miles from Anchorage. The state revised Palin's W-2s because the distance between Wasilla and Anchorage wasn't large enough for Palin's travel expenses to qualify for the per diem reimbursement. RIA observation: Federal law doesn't help Governor Palin either. IRC §162(h) allows state legislators to elect to treat their residence as their tax home for purposes of the per diem reimbursement if their residence is more than 50 miles from the state capitol building. Since Wasilla is less than 50 miles from Anchorage, Palin cannot make this election. Bill McAllister, Palin's press secretary, has indicated that Palin will make the necessary tax adjustments and comply with all pertinent IRS rules and regulations. Ok, another way to look at this: Is it just Obama's picks that have tax troubles or is it the thoroughness of his vetting process? This we don't know. From what I've read, he has gone deeper into backgrounds than anyone else has. Of course, that doesn't change my opinion that you could probably throw a dart at most of our elected officials and find something that sticks. Remember one of the fine politicians on your side, John Doolittle, is battling his ties to Abramoff (sp?), and the fact that he was funnelling funds to his wife's 'consulting' business. And his returns were pretty sketchy; but since he's not being appointed by Obama it doesn't get the attention. And of course the other charges against him overshadow a lot of the smaller things like taxes. And his replacement, arch conservative Tom McClintock, didn't pay tax on his per diem that he collected for traveling from his 'home' in So Cal (mother's address) even though he and his family lived in a home outside Sacramento. In other words, he collected tax free per diem for days he worked in Sacramento, even though he lived here. Rick Santorum ripped off PA in the same manner, as well as charging PA for the private school his daughters went to in DC. Does anyone here have a problem with these issues? But since Obama isn't likely to appoint any of these, they won't make the front pages.

Watch for state adjustments. For example, a CA K-1 could be different from the federal one because of nonconformity of depreciation expenses, or a lot of other items. If NY doesn't conform to federal law, (and I know PA doesn't) then the two would not necessarily add up to federal.

Well, I sent out 3 couples with paper filings but I did just create one with this work-around, and it creates fine. I hope it files fine.

Did yours go through? I called ATX and asked it that work around was ok (making sure you DO check the box on page 1 for 'filing status different than federal) and I spent over an hour on the phone and they really didn't know what I was asking them. Have you found the RDP worksheet anywhere? I was going to use that since I was preparing paper returns rather than the enormous package otherwise required and could not find it anywhere. doesn't work if you are efiling with w-2s but I figured since I was doing a paper file I could use it.

My dog, I love it. Except the postman already won't bring anything to the door. And now I have my newest feral, found, or whatever dog, Sweetie Pie, who has decided to move to the front yard instead of the back and loves to bark at anyone and anything. Except she is actually very timid and won't go near a stranger if they come through the gate. But because of the barking dog, now I don't get fedex or UPS either (who weren't intimidated by Alice, my other found doggie, even when she was trying to eat through the door to get at the UPS guy...she HATES UPS!) because of barking dog in yard. sigh.

Yeah, but the program requires you to enter the info anyhow, as does other programs. And ATX doens't like 'various' for some reason.

Yeah Deb, they shot themselves in the foot on that one. And as our colleagues in Michigan noticed our purchase money loans are non recourse. But any that owe more than they paid (unless they got an option ARM) must have refi'd and then its no longer a purchase money debt, and is full recourse. And I haven't figured out if someone purchased with an 80/20 if the equity line portion is recourse or nonrecourse. I think its non, but am not sure. If I remember this when I get to work on Tuesday, on my computer there I have a really nice document that spells out COD & foreclosure & short sales in plain english. Has nice little calculation examples too. But of course I forgot to email it to me at home! My ex is thinking of walking away from a duplex but when he financed it part was his primary residence, but since his brother, he and I bought it together a year or so earlier, but only his brother was on title, but then he bought out his brother, and got on title BEFORE he got the loan, I think the loan is recourse. I told him to read the loan docs closely. And you think your transactions are convoluted?? -
I emailed ATX and they said they have no idea why it won't efile. Sent them the return, so hopefully they will figure it out and fix it.

There was a Canadian study done which showed professional returns and self prepared hand done returns (paper, pencil & instruction booklet) had an error rate of 5-15%. self prepared software returns had an error rate of 30%. You might think easier returns are done with pencil & paper, but I've found that people that do it the old fashioned way tend to have some understanding of what they are doing, since they have to read the instructions, whereas those that just answer questions in a computer program often have no idea of what they are doing or where it ends up. -
I can check out a return by looking at it and asking a few questions. Who needs a computer program? Sheesh! I wonder if Block checks out if they missed putting in the AMT or claimed dependents they shouldn't have?

Me too, never thought to limit the asset entry to 50%. Always just cut it in half before entering. Could limiting it mess with bonus depreciation? For the Sch E, you can indicate ownership is 50% & enter income & expenses at 100% & the program will split. I alway enter my rentals that I co-own already split (use a spreadsheet) because otherwise the auto expenses that I have solely (ex doesn't keep track so doesn't get any) for my car would be split since there isn't an option to pick and choose which expenses are at 50%.
