    I was wondering where she was; she never seemed to sleep since she'd be posting when I was up working at 1am PST! Sending thoughts of strength and caring at such a difficult time. She will definitely be missed on here. I hope she checks in occasionally, even if just to say hi and see what JB's having for lunch.

  4. Is the military person domiciled in CA? Or FL? The way I'm reading this TP is military, military domicile is state of residence when entering the military, unless the military taxpayer changes it. Is spouse from CA, and therefore has CA domicile?

  8. Most of Newt's speaking & other income is reported on the 1120-S from Gingrich Enterprises, which I read in Forbes, is now Gingrich Productions, from whence Callista got her wages. The Sch C for speaking is probably one that got reported under his SSN. $8505? It's really not that complicated a return. I've got a few that are much more complex than theirs. I could live quite nicely with a few clients that would pay that much for a that return. Now it's the 1120s's I'd like to examine!

  10. I started including the depreciation schedules when I got new clients that didn't have them, and discovered what a pain that could be. One client I got had his preparer die suddenly during the year, and had a heck of a time even getting his docs back, much less any prior year info, like depreciation schedules. I'm currently trying to deal with a habitual late filer whose prior preparer is insisting everything is in the tax returns..but there is no depreciation schedule, and his main source of income is a 2 unit rental. I've scoured the returns I have, but there have been too many things put into service, including improvements, plus him converting one unit from personal to a rental that I simply cannot recreate the depreciation from what is contained in the 4562s I have. I put the tax return with the necessary reports (but not worksheets) in an ATX-styled return cover, and their docs in a two pocket envelope, unless they only have a few in which case I staple them in back of the return. I make copies of all of the docs I used to prepare the return, although I'm slowly switching to scanning. I'm starting to include two year comparisons, adding them somewhat haphazardly to the returns each year. I have personalized pens and refrigerator magnets I give out. The magnets are new this year, and my first efile client today specifically asked for one. She loves the pens, and I usually have one or two on me. For awhile I had run out of biz cards and just gave out pens. I've also had compliments on my tax package. It looks very professional, and the return covers don't cost much.

  15. Alaska allows you to opt into community property. GA is a sole property state. How was the property held? Was it hers from before the marriage? You probably need to ask your client some more questions. And I agree with jainen, seeing a copy of the settlement would probably help.

    Don't know; I've never had to use that block. Just the code 'D' and the amount for a 401(k) or 'V' for the NQSO.
  17. The cooking stones are great for pizza though! when I bought from them, the rep had only samples, no inventory. You placed your order with the rep, the rep ordered from the company, and then delivered the goods after they came in.

  19. Still haven't seen an answer as to state. If community property laws come into consideration, for example, in CA, her separate property is her separate income, unless comingled. And the community ends when the couple separates. However, in TX, separate property generates community income and the community doesn't end until the date of divorce. In AZ, the community ends at the date of divorce, but separate property generates separate income. And in CA, it doesn't matter how the darn title was held if the property was bought with community income. Probably the same in TX & AZ. So again, unless you give us more info, you can't get a decent answer. Garbage in, garbage out.
  20. Yup, me too. And since the 1096's don't have to be filed until March if efiled, you've got plenty of time to make corrections before the final copies go to the IRS.
  21. It depends. What state are you in? Property laws are determined by state.
  22. Your client should get a 1099 from Pampered Chef for the commissions and any bonuses earned. There shouldn't be any inventory; when I've attended such parties, you place an order and the rep then delivers your product. Should have demo expenses (they prepare food to show off the products at the parties), mileage, and demo equipment they've bought.

  24. I'm never in the first batch. I have two appointments for Friday, and one is SE, so they may have all their stuff together. But until the state of CA issues their W-2s, I'm pretty quiet. Living in the capitol, I have a LOT of stateworker clients.

Makes me realize how much I've missed William- he provided the same kind of background info that really helps us understand the programming end of things, not to mention quick help on these issues.
