That's why I only used a one page questionnaire, which included a request for ALL TAX FORMS received, with the list, W-2s, 1099's, W-2G's, 1098's, etc. And 'obvious' questions like "Any new dependents?" "Did you get married, divorced, buy or sell your home?" etc. Amazing what they can forget to mention, isn't it?

Totally agree with Rita. By the time the 'new' preparer or the client asks, their decision has been made. All you can do, assuming you wish you could retain them, is keep the road back to you smooth and open. And if you don't want them back, why delay tying up loose ends? So be nice, be helpful, and be professional. -

One single return, even if signed, will not get you "lumped right in there with the rest of" the bad preparers. But the call has to be yours, because you have to be at peace inside. I do like Sara's option: "Explain to the parents that you'd really like to help their children out but the IRS has strict controls over EITC returns and the responsibility is so great that you can't do it without interviewing the children and charging a reasonable fee for the risk." While I'd never say Block or JH can do a much better job than me, I have told some potential clients that these chains are experts in EITC returns, and are less expensive than me.

AR does have a special cap gains tax rule, but not based on feds. Only 70% of LT CG is taxed, all ST CG is taxed. Tax rate is ordinary, no special rate.

They can't get that unless you CHOOSE to give it to them. This is one subject where there are no short simple answers, so if you're smart, you will not go there.

And therein lies the problem! Unless a crime has occurred, they should not be able to keep a dime of it. And they should have to file the criminal charge within a reasonable time frame, too. Not keep it hanging until in desperation the innocent business accepts a settlement to avoid bankruptcy.

If he chooses too, it could probably be a very token amount, based on the amount of time spent on corporate activities. I always advise discussing this issue with the client, explaining the options, but always let [make] the client make the decision. -
I agree with Papa Joe and Sara, this son never had any incidents of ownership. He should report it as a zero profit/loss sale, and give the money to Dad, leave Aunt out of his side, that's between Dad and her.

Correct, Max, not for 1/2 a year. I guess that local Judge [who was actually pretty much of an all around idiot who just happened to be "well connected" in our area] never filled out a tax return for himself. -

True, although I always encouraged them to put any significant decisions into writing, and have the members sign it. Avoids a lot of future disagreements and protects them all. -

What you are overlooking is that while it's INCOME will be TAXED as a corp, it is legally an LLC, which has some benefits in areas like estate planning, etc, and may, in some states be taxed more favorably as well.
