  5. I had the same reservations about the lawn-mowing, but if all his 'customers' are private homes, it DOES meet the household employee description, so he could get a pass. Pacun, I hope this cleared up the $5120 issue, which is the limit for INCOME TAX, not for SE tax. Although there is that odd-ball exception to SE tax for a kid with a paper route. ;~) Isn't tax law fun?
  6. disclaimer: this is in no way meant to be insulting to any Italians but the joke only works if the woman is Italian. A wealthy man was having an affair with an Italian woman for several years. One night, during one of their endezvous, she confided in him that she was pregnant. Not wanting to ruin his reputation or his marriage, he would told her he would pay her a large sum of money if she would go to Italy to secretly have the child.   7. I must admit that is the part of the CP laws that makes no real sense to me. How do you report 'your share' if, in fact, you did not 'share' in it, or even know how much it was? I'm not in a CP state, but even here, I see too many cases where one spouse is working a W-2 job and having extra held out to cover the taxes of the self-employed spouse,and when they split, it's always a mess.
  8. You are mixing two different things here, Pacun. And you have the cutoff amount wrong, too. If he's a 'household worker' then you are correct that he has some special rules, but working in a resturant is not considered a 'household worker'. A household worker is an employee who performs domestic services in a private home, local college club, or local chapter of a college fraternity or sorority. Code Section 3306(a)(3). Household workers may not be subject to FUTA. A person who employs household workers is an employer subject to FUTA tax if, during any calendar quarter in either the current calendar year or the preceding calendar year, that person paid cash wages totaling $1,000 or more to such household workers. Code Section 3306(a)(1). Of course, the worker does not pay the FUTA taxes, only the employer pays them, and they are not on the W-2. They are subject to the other payroll taxes, however. Only exception I can think of for being exempt from FICA and MEDI is if it is employment by a school, under the special student worker rules. Work-study, for example. Now, of course, those rules do NOT apply if the minor is working FOR HIS PARENT OR PARENTS, in a business that is solely owned by his parents, and not a corporation. It can be a partnership, but only if the partners are only his parents. If that is the case, then he is exempt from FICA and MEDI, and it is not limited to any specific $ amount.
  9. No, do not include all the federal income as nontaxable in the bottom section. That is only for explaining special items such as non-taxable dividends where, for example, you have an investment in mutual funds where some % is in AR investments, that are exempt in AR. In the case of a non-resident or PY resident, the difference between col A & B and Col C explains why it's not all taxable in AR. Only report down there items that are AR income, but are not taxable for some reason. If you look at the bunny hop for that section, you will see that it relates to the AR4, where the red memo at the top of the page tells you to make the adjustments on the federal interest or dividend input sheet.
  10. That is correct. He would have owed the 10% tax, just not the interest. Still, given the way that ad is worded, I think they could be held to paying both the tax and the interest, in this case. Had I made the error, I would not pay the tax, which was the client's tax because he owed that because he pulled the money out early. I would not pay the interest, in many cases, because the client had the use of the money, not me. I would sometimes pay it as 'customer relations'. I would always pay any penalty added due to my omission or error. That would not include penalties due to his actions. only those due to my actions. But that is because I would not ever word an ad or guarantee the way they worded that one.

    Glad you enjoyed it, Eli. Sounds like you had a productive trip. I'm glad they food was still good. It's been several years since I was there.
  14. And I, for one, respect you for going back and editing your reply. It takes a bigger person to admit a mistake and try to fix it than it does to bluster and pretend no mistake was made. We all make mistakes from time to time. Admitting them is never really easy.
  15. The first date was totally stupid, as it gave those who are affected almost no time at all to respond. That was especially dumb as it required that it be done using specific software that some who are covered might not own. So those folks would have to not only rush to buy the software, but learn to use it, very very fast. I'm glad most of us will not be affected at all, and glad that those who are have enough time to deal with it.

  17. Also, AR lets each spouse be taxed on their seperate income, which tax is then added together. So unless the spouse has less than 500 in income, it almost always benefits them to use Status 4. Be sure you try it both ways.
  18. No, you do not prorate the deductions. You put in the federal income in col A and B and the state income in col C. Put all the itemized deductions in the return. The way AR does this is to calculate the tax on the total income, then take the proportional amount of tax, based on the ratio between AR income and total income. This happens on line 44D.

  22. I think he had the right number, but attached to the wrong subject. I think that is the estimated cost of 'tax preparation' in this country, but that includes business returns as well. So you have GM's tax preparation in there, for just one obvious example, and all the other smaller businesses, partnerships, corps, even estates and trusts, etc.
