  2. OK, that makes more sense. I'd consider filing an 8919 in this case, but first I'd consider calling the employer and explaining how to handle this correctly, using the Sch H, and gently explain that unless she does correct the W-2, you will have to file an 8919 and that will bring the IRS down on her head.

  4. Hope you are reminded that our lives count every single day..........Michelle RED MARBLES I was at the corner grocery store buying some early potatoes. I noticed a small boy, delicate of bone and feature, ragged but clean, hungrily apprizing a basket of freshly picked green peas. I paid for my potatoes, but was also drawn to the display of fresh green peas. I am a pushover for creamed peas and new potatoes. Pondering the peas, I couldn't help overhearing the conversation between Mr. Miller (the store owner) and the ragged boy next to me. 'Hello Barry, how are you today?' 'H'lo, Mr. Miller. Fine, thank ya. Jus' admirin' them peas. They sure look good.' 'They are good, Barry. How's your Ma?' 'Fine. Gittin' stronger alla' time.' 'Good. Anything I can help you with?' 'No, Sir. Jus' admirin' them peas.' 'Would you like take some home?' asked Mr. Miller. 'No, Sir. Got nuthin' to pay for 'em with.' 'Well, what have you to trade me for some of those peas?' 'All I got's my prize marble here.' 'Is that right? Let me see it' said Miller. 'Here 'tis. She's a dandy.' 'I can see that. Hmmmmm, only thing is this one is blue and I sort of go for red. Do you have a red one like this at home?' the store owner asked. 'Not zackley but almost.' 'Tell you what. Take this sack of peas home with you and next trip this way let me look at that red marble', Mr. Miller told the boy. 'Sure will. Thanks Mr. Miller.' Mrs. Miller, who had been standing nearby, came over to help me. With a smile said, 'There are two other boys like him in our community, all three are in very poor circumstances. Jim just loves to bargain with them for peas, apples, tomatoes, or whatever. When they come back with their red marbles, and they always do, he decides he doesn't like red after all and he sends them home with a bag of produce for a green marble or an orange one, when they come on their next trip to the store.' I left the store smiling to myself, impressed with this man. A short time later I moved to Colorado , but I never forgot the story of this man, the boys, and their bartering for marbles. Several years went by, each more rapid than the previous one. Just recently I had occasion to visit some old friends in that Idaho community and while I was there learned that Mr. Miller had died.. They were having his visitation that evening and knowing my friends wanted to go, I agreed to accompany them. Upon arrival at the mortuary we fell into line to meet the relatives of the deceased and to offer whatever words of comfort we could. Ahead of us in line were three young men. One was in an army uniform and the other two wore nice haircuts, dark suits and white shirts...all very professional looking. They approached Mrs. Miller, standing composed and smiling by her husband's casket. Each of the young men hugged her, kissed her on the cheek, spoke briefly with her and moved on to the casket. Her misty light blue eyes followed them as, one by one, each young man stopped briefly and placed his own warm hand over the cold pale hand in the casket. Each left the mortuary awkwardly, wiping his eyes. Our turn came to meet Mrs. Miller. I told her who I was and reminded her of the story from those many years ago and what she had told me about her husband's bartering for marbles. With her eyes glistening, she took my hand and led me to the casket. 'Those three young men who just left were the boys I told you about. They just told me how they appreciated the things Jim 'traded' them. Now, at last, when Jim could not change his mind about color or size...they came to pay their debt.' 'We've never had a great deal of the wealth of this world,' she confided, 'but right now, Jim would consider himself the richest man in Idaho '. With loving gentleness she lifted the lifeless fingers of her deceased husband. Resting underneath were three exquisitely shined red marbles. The Moral : We will not be remembered by our words, but by our kind deeds. Life is not measured by the breaths we take, but by the moments that take our breath. Today I wish you a day of ordinary miracles ~ A fresh pot of coffee you didn't make yourself. An unexpected phone call from an old friend. Green stoplights on your way to work. The fastest line at the grocery store. A good sing-along song on the radio. Your keys found right where you left them. Send this to the people you'll never forget. I just Did... If you don't send it to anyone, it means you are in way too much of a hurry to even notice the ordinary miracles when they occur. It's not what you gather, but what you scatter that tells what kind of life you have lived!
  5. I found it for you. Secret was to use fire* as the search, because the name of the thread was "Firefighter meals/Per Diem" rather than fireman. Firefighter would have found it, but using the wild-card * solved the problem.
  6. Due to a power outage, only one paramedic responded to the call. The house was very dark so the paramedic asked Kathleen, a 3-yr old girl to hold a flashlight high over her mommy so he could see while he helped deliver the baby. Very diligently, Kathleen did as she was asked. Heidi pushed and pushed and after a little while, Connor was born. The paramedic lifted him by his little feet and spanked him on his bottom. Connor began to cry. The paramedic then thanked Kathleen for her help and asked the wide-eyed 3-yr old what she thought about what she had just witnessed. Kathleen quickly responded, 'He shouldn't have crawled in there in the first place .......smack his butt again!' If you don't laugh at this one, there's no hope for you.
  7. "why does she not respect the POA?" Because she is not very good at her job, and/or she is a bully. But in this case, it's not worth a fight, even tho you are correct, and she is clearly in the wrong.
  8. It does not limit you from taking depreciation on other assets, but it does mean you do not take depreciation on the vehicles. The standard rate includes a portion for depreciation.
  9. Sounds to me like he is getting his tax advice from Betty Sue and Jerome. They are from your part of the country, you know. Of course, you contributed to it. After all, you told him that "inheriting the bonds was not taxable..." and he inherited the house, right? See, you confused the poor guy! Sometimes we just can not win. If you give him the full lecture, he stops listening after the second minute anyway. And he'll only 'remember' the parts he likes.
  10. Those two statements are not consistent. Either she did withhold, as you first say, or she did not. Interesting that this is a mother/daughter issue, which means apparently that the older child was paid to care for her younger siblings. Given that it is family, seems to me the logical way to deal with it would be for her to ask Mom to just pay her the missing $500. But if it were me, I'd be very leery of getting into this family fight. There could be all sorts of reasons why she did not do that. Could be that the girl is telling the truth, but I don't see any way to know that for sure. Unless she had checks with withholding mentioned on them, I do not think the IRS would be interested in getting into this either. It sounds like a lose-lose thing for you.

  13. All great ideas, my only input would be to remind you not to get locked into a schedule. If the boys totally get entranced by any specific thing, like the interactive museum, for example, don't yank them away just 'to keep on the schedule. You want the trip to be a wonderful memory, and that requires some flexibility. If they have fun, plenty of good fun food, and your attention, they will be talking about that trip fondly for many years.
  14. When I tried this, using code N, the program properly reported the amount in box 16a. with no amount shown in line 16b. Try restoring the box for the code, then reenter the code. But you need to correct the first 1099R, since it was 'corrected' by the recharacterization. Do that by adding the rolled back amount on the first 1099R. in the third box, for 'amount in Box 2 that was rolled over'.
  15. Sorry, I've just been too busy to check into the board lately. Trying to catch up with the drop offs, and keep up with the appointments, and keep track of meals, pill times, etc is taking all my energy these days. I do try to read a bit now and then, but it's just not possible to do it all. My husband is now able to do a little, which helps. But I've really never been this snowed under.

    Well, it seems to me the question you need to ask FIRST is how often does she rent it? If we are talking about two or three times a year, then I'd go with it on Line 21. But if it is many times a year, then I think you have to consider it a business, frankly. I do not think anyone can have it be a non-business if it is done on an on-going basis, or if there is advertising of it's availability, etc. So I'd just ask a lot of questions, before I offered any opinion on where it would be reported. And remember the 14 day rule. If it's less than 14 days, total, does not have to be reported at all, but no expenses either.
  17. Now your bias is showing, Jainen. This was started by the banks [plural] that he was moving these large amounts through. And while I am sure that the GOP does not mind that this might give the Dems in NY a bit of a black eye, it really does not have anything to do with "the White House". It's not like the GOP 'tricked' him into this situation, is it? [pun intended] And to go back to my original question, which was never answered, where did you get the "Then the White House steps in, and all of a sudden it's gone --" ? That was what I did not understand about your post.
  18. Where did you see anything about the White House getting involved? I've been following this story, but have seen nothing about any intervention from DC at all. From an AP story: By the time the scandal broke this week, Spitzer's financial transactions had been monitored, his phone calls had been caught on tape, and his actions had been scrutinized by federal prosecutors. It could have been straight out of the Spitzer prosecution playbook. A person familiar with the investigation told The Associated Press that the probe began with a referral from banks to an Internal Revenue Service office on Long Island about suspicious transactions involving accounts ultimately traced to Spitzer. The IRS studied the records and then referred the case to federal prosecutors in October. It was then assigned to the public corruption unit of the federal prosecutor's office in Manhattan. Speaking on condition of anonymity, a law enforcement official said Tuesday that Spitzer, in fact, had spent tens of thousands of dollars with the Emperors Club. Another official said the amount could be as high as $80,000. But it was not clear over what period of time that was spent. From a CBS story: Sources tell CBS 2 HD the governor knows this and is using his defense team, led by Michele Hirshman, to leverage his resignation against potential charges he may face. When asked what the best-case scenario is for Spitzer, Fischetti said, "No charges, absolute resignation and contrition. I think the worst that could happen is a felony plea on a number of charges they could lodge against him." Fischetti says that as a former prosecutor himself, Spitzer would not want to plead guilty to a felony that could carry jail time, like tax evasion, money laundering or bringing a prostitute across state lines. "The main thing I would do is not plead to a felony because if he does that his law license is toast," Fischetti said. "He can't practice law anymore." Sources tell CBS 2 HD that Team Spitzer spent much of the day in talks with U.S. Attorney Michael Garcia and his aides. The failure to reach an agreement may have to do with the pressure Garcia feels to make an example of Spitzer. "It's very important that [Garcia] expresses to the public that everyone is treated alike and he doesn't charge someone who was the Attorney General and prosecuted crimes he will be subject to a lot of criticism if he lets [spitzer] go because he was the governor," Fischetti said.

    OK, here's the straight deal on this one. If she owns the land, and she is getting CRP payments, she HAS TO FILE A SCH F, IN HER OWN NAME, AND PAY SE TAX ON THE INCOME. That is the rule, for ALL CRP payments. There is a Rev Ruling on this, don't remember the number, but you can find it if you look. There is a bill in Congress now to change this, but it is going nowhere while the pols play their political games.
  20. Maura, that's an interesting cite, thank you for posting it. But, it is discussing how the estate should handle it, which is significantly different than the rules for the heir. Once the heir has the property distributed to him or her, they hold it either as personal, if they use it personally, rental, if they rent it, or investment property, if they do neither of the other two. As investment property, it would be eligible to create a capital gain or loss.

It usually works out best for him to be a full year resident of one or the other, although if he files on both states as a part year resident, neither will tax the money in the other state, and neither will give credit for the other state taxes. In my experience, LA is rough on non residents, so it may be best to be a LA resident who spends some of his time in MS. But I'd work it both ways. Actually, all three ways. Thank God for software that makes it easy. Just duplicate the federal enough times, then do the states each way. However, if he has property in one state, and his driver's license, etc is in that state, then that should be taken as his 'resident' state, and let the other state be filed as non-resident, and take credit as allowed in the resident state for the taxes paid in the non-resident state.
  22. Those numbers do not pass the smell test. Your client might not understand the actual settlement. Most likely the attorney got one third, and the other amounts went to pay medical expenses. He might not have any taxable income, if the settlement was for physical damages. You need to read the actual settlement papers, or else get a letter from the attorney as to what the settlement went for.

Well, if they are not required to include the balance sheet info due to size of business, I would leave it blank this year, but get the info to determine, as close as possible, the ending balance sheet for 2007. Then, set them up at least a basic set of books, at least on your computer. Then, next Dec, you can start working on the ending balance sheet for 2008, and use the estimated one for 2007
  24. Well, I have to agree with MichaelMars on this one. I know a lot of you like to do this, but I always wonder why you 1) cheat yourself out of doing [and charging for] a 1065, and 2) cheat the clients out of some of the protection that they set up the LLC to provide to them? What is the point of what you are doing? I can just imagine if, down the line, the clients are sued, and have to go to court, and are asked to provide proof, in the form of tax returns, that the assets are in an LLC, and thus protected. I'd think that if they then had to admit that they had no such returns, their lawyer would be advising them to sue you for their resulting loss in that case. And why? Just to save THEM from having to pay you for a 1065 return that they should have filed?
  25. No, because you made a 'custom' form, so that it would not replace the standard one you have, just the custom one.
