  4. We can make this an informal court and allow Pro Se representation (for those that don't know Pro Se is a Latin adjective meaning "for self", that is applied to someone who represents himself or herself without a lawyer in a court proceeding).
  5. So, http://dollarssense.com/ is the website they setup for you? Couple of questions. Is the content on the site all provided by ExecSite (other than the contact info)? Or did you add your own links? does it seem to help generate revenue and or new clients? What do your clients think of the site? Are there any additional charges based on content?

  9. Intuit is notorious for trying to find ways to make you spend money and upgrade. THey have continually crippled features that they used to bundle with the software and then ask you to buy them as separate modules. They also have bugs, too numerous to mention that they refuse to fix. These tend to be known issues that they either fail to tell their teck support about or tel their support to lie about. On the other hand all our clients seem to use this piece of crap! Give your clients an option of keeping up with the upgrades and your version of the software or paying you additional, l like Jack said, for your extra time and effort. And personally, I think you should suggest they pay you and blame Intuit!
  10. As an attorney I generally feel this is a good letter. Says nothing and has caveats. Not so sure I like the wording of the last paragraph, but do like the content. And puts the responsibility right back where it belongs, on the lender to due proper Due Diligence. With all the fraud the lenders have done over the last few years, it is about time we put them back on the hot seat. It is also time the lenders stopped this "Stated Income" loan process as it is full of fraud. I also like the comments on the article from the AICPA. Don't let the mortgage broker put you at risk. He is generally the one in a Real Estate deal doing the FRAUD, trying to lay this responsibility on others. Just take a look at the current status of our real estate market in this country and some of the loans your clients have on there homes. Every time I tried to explain to a client why they should not close a particular loan or that they were purchasing outside their means, the lender would suggest he was the one on their side not me. And try to convince them (usually successfully) to go forward. Now they are in trouble and come back crying for help, as one after then next gets foreclosed on. How soon do you think the lenders are going to try and go after the CPA's for this? And you might want to let your clients know that stated income loans will cost them higher fees and interest rates as a general rule. On another note, the same issue occurs when our clients have S-Corps and some of the income flows through the K-1. Underwriters and lenders just do not understand the K-1 flow through. I have often had lenders ask for the SE letter when they see income from my clients S-Corp. Can't ever seem to get them to understand that this is not Income from Self Employment.
  11. I vote under several names! I think most of them are dead now too. And wonder how it will be when I move to Vegas. After all the mayor there, used to be mobster hitman, Giancono's attorney, so politics should be fun. Maybe I will run for office there, rather than Judge here. After all no-one here has voted for me yet, and mob politics has to be much more profitable.
  12. Does not sound right. If he sold his interest directly to another partner he should get a K-1 with his prorata share of income from operations. You would then have a gain or loss to report on the sale of the partnership interest based on his "Outside Basis", which will most like be the same as his inside basis/capital account.

  14. Had E-fax as well at one time (when it was free). You might want to look at the alternatives though, there are several that offer better deals today than E-Fax.
  15. Excellent points here as well. The disclaimer is a a tough one though. From the CPA's perspective it seems necessary, however, it probably will not fly very well with the Underwriter. You must assess how comfortable you are with a particular client's situation. If you are the least bit wary, the disclaimer may be necessary, or a better answer might be to say that you do not write these types letters. Be very careful of writing these letters!
  16. 100% AGREE. As lawyer that does a lot of real estate work, the mortgage brokers are trying to get out of the line of fire and put that on the CPA's. You need to be very careful that you don't become liable should your client one day not be able to pay this loan. And never say you have prepared the returns if you have not. State absolute facts only. Of course the downside is that your client will not be very happy if you don't write the letter.

If you sign up on this site you may not see at first it was a part of fax2mail.com and that you need to address everything to fax2mail and not saveonfaxes.com.   18. In a lot of ways I think he was and is a better Mayor and politician than his father. He did have more limitations though. Different times, more eyes and less chance to be corrupt. And he never had the power his father had, because of when he became Mayor.
  19. It really does save paper and ink. Also it is a lot less frustrating deleting a advertising fax than crumpling that paper and throwing it away.
  20. Ok I was trying to be funny, But I will be serious for a moment. I hold my ethics in high standing. When I don't know if something is against the Rules of Ethics, I call my Bar and run the question by them. Good thing, is I rarely need to do this as I do understand and do follow the Rules of Ethics religiously (can't say the same for many of my brethren in law). And, I have even taught ethics to accountants (did an in-house course in a CPA firm I worked at years ago). I also can't tell you, how often I get clients that want to know how to do something illegal and get away with it by getting my advice as an attorney. If I can't get them to understand that something is a crime or unethical and that I can not participate in such an act by giving advice, I have terminated the conversation and essentially thrown them out of my office. And as I tell my clients, friends and family, ethics and morals goes beyond the law. You have to wake up every morning, and look in that mirror and like who you are and what you have done on this earth. I personally want to be able to look at myself in that mirror and like who I see. So now I am off my soapbox.
  21. I actually have 2 different services, one I use for receiving faxes and one for sending. So why would I use 2? Well: To receive I have had an account with www.Packetel.com which is only $3.95 per month for "Unlimited" fax receipts, but you can not send with this account at all. I like the fact that all my faxes now come to my desk in e-mail in PDF format so it is easy to save and no conversion or scanning. Much cheaper than me or a secretary taking the time to scan them. I used to use a standalone fax or my computer fax to send. But now I am trying to sell my house and moving to NV, so had "Stage" the house. This caused me to have to rewire my lines to hide my Vonage Box and I was no longer able to tie into the house wiring for phone, so lost the ability to use my regular fax. Then I subscribed to a temporary fax online account for sending only. Fax2mail.com or its sales company http://www.premiereglobal.com had what I thought was a pretty good deal at $8.33 per month for 350 incoming or outgoing fax pages monthly. Since I am only sending with this account 350 is usually more than enough for me. However, were I to receive I would be over in the first 10 days of the month in the slow times of year. What is really nice about this is no-one is choosing your allocation of sent vs received faxes, which most of the online fax companies do. Have only had this new service a couple of months and did have a few growing pains, like maintaining fax logs, but support was good and setup the account on their end to give me what I needed. You do have to send via email by attaching the documents you want to send. I attach PDF's but they do accept some other formats as well (not sure which, as PDF works for me). Once my move is complete I will reconsider going back to my old method or continuing with this or another service. Although, I am really beginning to like sending via e-mail and it leaves a nice record of what you sent this way. I also looked at the service from Comodo at http://www.trustfax.com that is very competitively priced, posted above by Jerry. They have a Pro deal where you get 400 Receive Pages, 125 Send Pages, Faxes are Sent To Your Email, you get a Fax Inbox - Unlimited Storage and US Local Fax Number. For lighter use you can get their 100 send, 50 receive pkg. It also looks like they have far more options than the others, including the ability to maintain faxes on their server and receive them via email. This probably doesn't work for me as sending is my issue and 125 probably not enough, but it may work for others here.. Finally, when I started using fax2mail, I was able to turn off my fax telephone line that was costing me $10.00 for the line plus roughly $5.00 in taxes. Then I went and got a virtual NV telephone number for $4.95, and another Packetel NV fax line for $3.95. Net cost almost the same, but now I have 5 numbers, lots of options to expand the business in a new market while maintaining the old market and well a little extra confusion. I think am seeing extra business from the extra lines, and expect that to improve in the long run. Hope this helps

I know I have to prorate, and I know that it it is on page 2 of the NJ 1040 where I have to somehow adjust the interest amount, but I am wondering if there is a schedule, or I have to override the line for interest, which is currently pulling from the 1099 input. Guess I just find it hard to believe there is no schedule to do the proration and that I am required to MANUALLY override to get the correct answer. Figured the software would have something to handle it. At this point I have done an override and created an itemized list to detail the proration.
  25. Looked at both TRX for $299 and TRX -TW (which is CCH's other product that gave us all the support headaches- TAXWISE). Neither has the depth that ATX has nor anywhere near the volume of forms that ATX has. And I rarely (especially with this board) needed ATX support So its ATX for me
