I just prepared a return for a client for whom I had a note in the file that last year she got a check because I forgot to click the Direct Deposit box before filing. You know how some people say at pick up, "Oh, yeah, I want that to go to my bank account," and you smile and say, "Oh, sure, no problem," (even though it really is a little bit of a pita), and you enter the numbers but forget to click the &*^% box? Maybe that happened.

Charge her full return price when the letter comes: "Where's your 8962?" P. S. I can't find the definition of pertute, I'd have to charge her for that, too.

You are correct, and he is not (because he earned over 4,150), but he will not have to repay the APTC.

@Christian If your household size is zero on Line 1 of kid's Form 8962, you have the box unmarked on his 1040 Main Info tab, indicating that the parents are claiming the kid. Dependents are not applicable taxpayers and pay back all Advanced Premium Tax Credit. His income is not too high.

Yeah, I was thinking about this some more, and I think Christian has the box unchecked indicating that kid is claimed by parents. His income is not over four times the poverty rate. That's the opposite of how we used to handle the box, and is a bit awkward. I think that's the problem.

$27,500 is only 228% of the poverty rate. I think you'll be ok if you allocate the numbers on the 1095-A to the kid. I had to do it last year with a mom and a [No Longer] dependent. Well, I had to allocate 1% of the credit received to the mom and 99% to the kid because of something wonky with ATX, but I was able to allocate 100% of the other columns to kid. It was torture, and I sat here for hours reading the Instructions to 8962. There's a thread in the ACA Forum. Hope this helps. As far as mom being covered by ER, that's how my situation and yours are different, my mom had Marketplace insurance, so I may be missing something painfully obvious.

I resurrected this four year old thread because I manually figured Section 179 recapture for a client last week, and I think (hope) ATX would have done this for me if I knew how to use it better. It's done; entered at bottom of 4797 and on Line 6 of Sch C. I'm glad I know how to do this, but I don't want to do it again. I've learned all I care to the hard way. So if you know what I should have done to get ATX to handle this, please tell me. No hurry.

Are you sure you are being warned to remove Form 8962, or just delete all entries except the actual APTC that they are repaying?

I would prepare the amended return now. If you want to tell them to wait until they get the first refund to mail it, that might be smart, or sound smart. The client expects you to make it right. I would not give them the idea that everything will be ok if I do nothing. I wouldn't trust that opinion if I were the client. Also, they are going to tell everyone in their life if they don't like how you handle this. They will tell no one if they like how you handle it, but you don't need negative advertising. And we've all been there, you're doing great.

Oh my, the things people will do! Actually, these folks thought it would all work out if he just called the number on the letter and had an honest 1.5 hour interview with the TCO. What could go wrong? Husband (engineer) told her that wife's little business was really more of hobby, she didn't really track inventory, and oh yes, we forgot about some merchandise in our attic. He sent TCO 110 PDF files on a thumb drive. TCO was livid the first few minutes she and I spoke, but by the end of the conversation she was laughing and said, "He's confident - I'll give him that."

Illmas, I represented a couple in a audit September 2018. The Tax Compliance Officer said the industry average for COGS for her retail store was 49.83% of gross sales. The taxpayer sells new clothing, jewelry, shoes. They had made such a mess trying to handle the audit themselves, nobody argued with me when I told them it was in their best interest to believe her and stop talking.

Of course you are right. Only I copy and put the "evidence" in a manila folder and don't charge more because in the poor South they'll leave you over twenty bucks. I know this because they'll sell Grandma for fifteen. Seriously, I've been very diligent with new clients for years. Existing clients not so much. I'm doing better, and apologizing for asking them for evidence that this kid I see with them on FaceBook everyday is really theirs, but I have no problem telling them why I'm doing it. I still think there's more to that NATP story than we know. Also, I just wish they'd push DIY a little more. /s

You are no doubt completing Sch SE for these self-employed folks whose income you entered on Line 21, right? At first I thought, "Well, that is going from the frying pan to the fire," but then I was ok. I'm posting anyway because people are leaving me alone and I don't want to work.

I would consider this activity a business and issue the 1099s.
