    ACA EXEMPTION

    Correct. My post should have clarified that even the exemptions shown in the charts that needed to be applied for ONLY from HHS --- could also be applied for on the return but you would need to use the "pending" for the code and your return would be "held" until resolved, etc. Yes, they also clarified in todays webinar that the average bronze was for the penalty but to figure the 8% you should use the most local bronze.   2. Except for the small business employers who have no plans. Then maybe IRS might require us (NOTHING RIGHT NOW) to have more than clients information and assurance they had coverage for all prior year, etc.. ACA and implementation has a few more years to shake out with more "required" changes forth coming. Remember, we have to read it to know what is in it. I have not read (completely anyway) it yet, so I am sure more is to come.

    I will stick with the earlier article from Forbes (this one you mentioned above makes me "groggy" again. Also, the Forbes seems to be more recent and incorporates changes made since the "groggy article here" was written. Please let us know which way works out for you (I believe the one employee is correct but do not know if there is a "deemed" employee mandate under less than 50 employees based on total PT hours worked or not).

    ACA EXEMPTION

    Via an IRS ACA Webinar today, both are correct with the EXPLAINATION that all exemptions can be applied for; when DOING THE RETURN (you just need to complete the HHS form/application and mail it in, and then simply MARK PENDING on the tax return (8965) being submitted. THIS IS WHERE the IRS sets aside the form when received and waits to process until the HHS either issues or does NOT issue the exemption --- THEN the ORS finishes processing the return and issues refund, etc. If HHS application done before hand (typical answer time before tax season was about 4-5 weeks) you get processed when tax form submitted --- if HHS application applied for when tax return is filed --- who knows how long before the tax return gets the exemption matched between the IRS and HHS and then still needs to get IRS processed????

The child is listed on the parents return and there is no requirement for showing they had coverage --- probably deemed "understood" From 8965 instructions: "If you are unable to check the box on your Form 1040 series return indicating that every member of your tax household had minimum essential coverage in every month of 2014 (and therefore you are filing Form 8965 to report or claim a coverage exemption or are making a shared responsibility payment), you do not need to take any action to indicate that some members of your tax household had minimum essential coverage for some or all months in 2014."
  8. Correct, according to an IRS Webinar today. ITIN's excepted from ACA but in a case such as mentioned here --- they would file 8965 using Code "C" exemption.
  9. According to the IRS ACA webinar today, ITIN DO NOT need to have the ACA insurance, etc. The exemption would be on 8962 and be a Code "C".
  10. Since this is for the "client", might I suggest that you use the Microsoft (MS) programs mentioned. Office 2010 is available as stated on ebay, etc. at nominal pricing. Open Office and other UNIX type things work well (sometimes even better) than Microsoft but given the "industry" NORMAL is MS, then save the client (and yourself extra questions from the client on "how does this work differently, etc.) the time to learn and use something NOT EVERYBODY else uses (Open Office, etc.) . Unless of course, you are also their IT professional and want those extra questions, billable times, etc.

    AND as far as penalties, DOL trumps IRS (only because the feds get more money). So is the IRS guidance --- good or do you use the DOL guidance. Thanks Rita for the article --- I was groggy before BUT with that article, understand a bit better.
  12. How about simple have a law that requires a "straight up or down" vote for each item? We could actually see and understand what our representatives believed and stood for AND understand the "REAL" issues ourselves. Please excuse the terminology in the next line; I just could not think of a 'correct" way to say it nicer. To fix things is really simple, to have the capabilities and //// insert your gender choice (balls or ovaries) /// to do what is good (yes, your opinion) for the country OVER your own ambitions.
  13. New is good. Different type question on SSD. I am going to put in my own "cloud" (read Western Digital NAS EX-2 which can come - drives empty (open) or at various TB storage whereas I just plug into my modem/router and I can access from anywhere. I will use RAID 0 and have about 4 TB storage (2 useable with 2 as RAID backup so to speak) This system can come with what are called "WD red drives" (basically drives designed to be run 24/7, etc.). These drives are at either 5400 or 7200 and are as we call them "spin" drives. FINALLY my question, what are your thoughts on going to SSD's rather than the "spin" drives. When accessing directly from computer (desktop or laptop) the SSD should/will enhance drive life, speed, etc. but do you think the extra cost and such is warranted for the "cloud" type I envision using. NOTE: I do not like "cloud" per say because you do not really control access if something happens --- HOWEVER --- if you have the cloud onsite or a site you control and under your control, then it may still be called "cloud" but a "cloud" I like.
  14. Just a side question/comment as I no longer do payroll, etc. for any of my clients and "Jack" has excellent knowledge. Is it part of your "payroll" service to make sure the employer UNDERSTANDS that the money NOW being paid for "health, etc." CAN NOT be demanded/even understood to be for "health" because that could be construed as a "plan"? The employee can spend it as they deem fit and still go out after "other health insurance" (such as marketplace, etc.) so the employer (if big enough) could still be "on-the-hook" for ACA penalties, for NOT meeting ACA requirements. READ this question as to not only 2014 but possibly in future years, etc.? Thanks in advance.

  18. ILLMAS, When you roll over you should see them. Also, ATX has said that on many of the forms they still have listed as drafts, that where there might be multiple data choices (names, etc.) that the draft form may not actually fully work until released as 'ready to file".
  19. The mod's do a great job when asked. The time limit means we need to re-read a few minutes out instead of next time in AND then realizing we made a grammer or word error that changed what we meant (but missed initially). However, with some work, we can fix that and if we do miss, given our mods's --- again they have always been happy to help. Is it possible to have an expanded time on the "subject" line. Again the mod's changed mine different times when I realized I could be more specific or such --- BUT --- a few minutes of "edit time availability" on the subject line might help too. Since, we are asking FORMAT questions --- is there a way one might "drop in" a poll question once the subject posts are being discussed/ An example, since Eric mentioned "toilet-paper rotation --- is there a way I might have been able to put a "POLL" in this comment? (asking of course -- are you an over front or down the back). Inquiring minds and those "crazy" (like me) want to know.
  20. Only in calories do zero's not really count. We were all taught 0, 1, 2, 3, etc. with 0 being zero and less than one (does NOT apply to checks or money owed to me) Therefore if one would munch on say 3,000 calories then you do not need to count the zero's --- therefore it is just 3 calories !

  23. I must agree. I missed the part (Sec 5000A is the part of the code that is the "Requirement to Maintain Minimum Essential Coverage".) in Judy's message that actually covered my statement. I assumed (and it did to me but not "U") that they had not defined "household" and "MAGI" and such under the ACA part of the code yet.. Again, I stand corrected. THANKS Judy for site and clarification --- let me know if you need any chocolate for the extra cost of sharpening the drill bit needed to get through my "thick skull".
  24. I actually think ALL PARTIES are correct. As Catherine mentions when (if ever) Pub 974 is released, we will know. Just as there are numerous definitions of various (sorry, forgot name of things described by just initials) in such things as "educational credits", etc. and other tax code publications; there may be MANY definitions of MAGI as pertains to EACH SECTION of computations in the ACA (not necessarily just IRS regulations. Food for thought.
