  1. This was very helpful Judy, thank you for taking the time to put it together. Last year I was one of a few "firefighter" preparers who was conservative on this subject as some of us did prepare a 1040X for the '17 returns. Some taxpayers did see the relief but others were asked by IRS to get a corrected 1099R which is not possible. It all depended on who was at the other end of the 1040X. I've attached the memo put out by NYC's Law Department for their feelings on this issue. I can see where they are coming from and it is the reason I didn't believe it was worth preparing an amended return last year. But with the few who did receive relief, good news spreads fast (we had a saying, telephone, telegraph, tell a fireman). So it's the luck of the draw, and I may as well join in.   2. Thanks Catherine, maybe someday it will happen. All the city has to do is request a ruling.
  3. Thanks Bulldog, I will give it a try attaching the disability determination letter which does state pension was granted due to WTC related illness. I will also attach the corresponding section of pub 3920 to help along the agent whose desk the 1040X lands on. The explanation from the city's corporation counsel is aware of this but the fact that a certain part of the pension is from accumulated additional contributions and interest by the retiree it is not considered part of the regular pension. The letter also states they would like to see a more substantial authority from the IRS. Worse that can happen is IRS asks for a corrected 1099R. We know where that will go. I will pass along your thanks to those members who were affected, all of them came down with weird form of cancer. Thanks again, Bill
  4. Publication 3920 states that terrorist attack related injuries and illnesses that contributed to retirement would be totally tax free. Since 2009 the City of New York has made taxable a portion of all disability pensions for monies received after 20 years of service. The publication states that taxpayers should have agency (fire and police in my cases) issue an amended 1099R. City won't do it stating legal mumbo jumbo issues. I have a few guys who would like to file an amended return with attached documentation from pension bureau stating pension is due to WTC related injury or illness. Do you think this will fly and worth a try?
  5. Yeah, just love it when they call and just found something new that you had no idea because it wasn't on previous year's return. I had one this year with a consolidated 1099 for a brokerage account that was opened 2 years ago, thought it was not taxable and not needed for return.
  6. Yes, same problem. One Federal, my Mom's of all people and one state. I understand that if stuck you can duplicate the return and re send the new return. This has been posted on ATX blog, although I think they just mentioned there were federal returns affected. Mom's not happy.
  7. Just to make this more confusing I think the DC cops and firefighters are paid partially by DC and partially by the Feds, not sure how pensions work.

  10. I would save a copy of the 7004 to desktop then from e file tab select attach pdf then scroll to the state section and at the bottom click on paperclip "other" then find the saved desktop item and attach.
  11. It sounds like this is all NYS source income so line 1 is correct. What you do need to fill out is the NYC 360.1 Change of NYC residence as he owes city tax up to the move. There is no city tax for NYC source income for non residents so he's good after the move. I don't think allocation worksheet is necessary. I will think up a NJ question for you later.

  13. I always have a few in the racks waiting for that last piece of info. I will harass them until they get off their butts and shake a leg. It's funny, I always say I won't start a return until I have everything, but that never works as I feel a need to keep moving. Too bad clients don't feel that way.
  14. I hear you Lion. I just finished a NJ part year, NY part year and change of NYC residence 360.1 form where I had to do manual calculations due to the "decoupling." It also took me awhile to figure out there is no NJ part year form because I'm so used to NY's and MA's PYs. I should have sent Yardley a PM, would have saved me some time and frustration.
  15. I have been using my i7 computer since 2013 and everything seems fine. It does worry me a little what ATX told you. I've heard there are printing issues out there. You could also check the official board for remedies. Good luck.

  18. I don't know about extra time, but I have my own Vanguard and Fidelity 1099s. I did get one TD about a week ago, but that's it. I've done 68 returns so far on track for my usual 110 by the end of the month. But surprisingly I've gotten none in the mail Tuesday after the long weekend. I would have expected at least a half dozen.
  19. Also, when on the 1040 you can click on "pages and worksheets," then line 66. 5 spaces down on the same list is the state estimated payments.

  22. Yes, I noticed that but "Filing as surviving spouse" does show up in signature space. At least it's half right, or half empty.

  24. Thanks Eric. I rolled over this return about a week ago before the form and worksheet was updated and I e filed it Sunday. But it was odd that the form didn't update itself when I checked on the rejection, I had to manually replace it. I always think it is something I did wrong anyway and always try to figure it out. I hardly ever call ATX, I'd rather come here or the official board. The parade was today for the other Patriots, the ones with the big paychecks. This city is electric today, and the only people working are me and Catherine.
