The main issue the IRS has is with preparers falsifying income/expenses to get the credit for clients. -

It will be a slap on the wrist and move on. Last year I got a visit about the 8879 and was not in compliance but the agent told me what needed to be done going forward and did not access the penalty. Our issue was not having both spouses sign the form not getting a signature from out of town clients. This has since been corrected and I am sure on a first offense of the EITC compliance visit you would get the same results. -
The IRS does not bat an eye unless there is a net loss. Even if passive the gains would eat up the losses unless there was a combo of passive mixed in but usually you are fine.

So if you go back to being an LLC -partnership you then need to file the 8832.

Interesting. I was curious if you have to refile the 8832. I have an LLC that elected S status that on 12/31/13 will be terminated because they are admitting a non allowed s corp shareholder. So it defaults back to LLC as partnership then you have to make election to be taxed as corp?

I think there is some 125 hour test somewhere for this but not sure.

I have dealt with most of my clients for 10yrs so I am very aware their docs are not false. For example proof they child is clients I answer because the client told me and I have known them for multiple years and have no reason to think they are lying. EIC checklist is a blanket checklist that unfortunately applies to all taxpayers. I might have 2-3 a year and its due to massive depreciation write offs or some other issue. When you charge $500+ just to do a return and do not offer bank products or RAL's you tend to weed out those that would take advantage of the EIC system.

So are 95% of the returns wrong or is 95% of each return wrong? It appears that if data was not entered exactly right then it did not pick up on conversion.

Without looking this one up I would venture to say yes as long as not claimed by someone else and they lived with the taxpayer the entire year. Is my memory correct or do I need to start using reference guides/google?

I think they are giving the taxpayer a chance to report without penalties and interest.

Interesting I have never used this form.

Any amount of the sale greater than the FMV of the assets would be considered goodwill. The amount of FMV over book value up to the original cost could be ordinary income/depreciation recapture. Ideally you want to structure so assets are sold at a FMV close to book value and the majority of sale is long term capital gain. If I am off base in my thinking please chime in.

I trust you. So I am okay that ATX 2013 isnt able to run on the server? All my workstations find the server as the file location to run off of but I do not see where on the server I can run 2013 so I just log on one of the workstations as Admin to setup the preparers and so forth.

We did the netowrk-server only install on the server and the network-workstation on the workstations. In trying to access the "admin panel" and it told me I could only change something from the server. On the server it appears there is no program installed as there is no program folder or program icon only a data folder. How can you access something on the server when the program does not appear to be there? Yes Jack from Ohio I followed the instructions as stated in the book and forgot all about the earlier years as this is obviously different since no mapping is required.

I received a few response to my post on the official board about performance times and some people are getting faster times than we are so it has made me think about what could be causing our slower times. Only thing that pops in my mind is that we have a few master forms that have been edited and I am curious if this could have some impact on the overall speed. We altered the invoice to always have a few boxes checked as well as the EF forms with pin numbers already entered for taxpayer and spouse. Just a thought and it might have no impact.

We have Drake up and running as well. Until a majority of the forms are available it will be difficult to truly determine if ATX has changed. As I have stated before I could care less about printing and editing client letters. Those are amateur issues compared to functionality.

So no one has compared the speed of 13 to 12?

I see no learning curve at all as it relates to input my learning curve is figuring out where things go.
