  2. Correct...The joint return I filed in 2008 was for tax year 2007.

I filed Joint with deceased spouse in 2008.....I think I will ignore until they sent a nasty-gram, then amend to show it included then excluded with form 982...or should I just amend now and mail it in? ....But if I include it...then exclude it with Form 982....how would they know if it was ever included to begin with?

    I thought the "old" way was kinda silly...Why include a form that the preparer was supposed to complete...and have it complete itself automatically? I say nice improvement!
  5. I think since the property is now a rental, the mortgage insurance would be a business expense included on the schedule E

    Has anybody received OH Acks yet? I hope to follow up with Karen Fisk on Monday....On Friday, I sent various e-mails to ATX, but have not received any response.
  8. I have never heard of needing proof to file as married.....Probably because there is little or no tax advantage to doing so....and thus, no incentive to do so when not really married.
  9. Some of you may remember that my wife passed away in March 2007. She had a lot of debt and I had no real assets at that time, so was insolvent due to medical bills. At any rate, I paid off all of her debt in 2007....settling with various companies and receiving 1099-C for these in 2008. All of these were included on my tax return last year....since I was insolvent at the time, I filed for 982 to avoid taxes on the cancelled portion of the debts. Today in the mail I received a 2008 1099-C from Kohls Dept. Store for my deceased spouse (her name and SSN) for debt that I paid in 2007! Now what am I supposed to do? Do I have to include that in my current year return even though the SSN do not match? I was insolvent in 2007 when I paid the portion of the debt not forgiven), but the 1099-C has a debt settlement date of May 2008. If I include this 1099-C on my current return, I should also be able to include Form 982...but how can I if the debt settlement date is May 2008...I was not insolvent in May 2008. Should I try to get a corrected for 1099-C showing settlement date of 2007? Is there any way I can just foget this 1099-C? It is onlt $819.00.....would increase my taxes by only $120.00...but I jave already filed my current year return and really do not want to amend. What would you folks do?
  10. Sorry Old Jack...It was almost 2:00am when I posted this....barely awake. Client is an individual. Client did recieve 1099's in prior years for very small amounts of income. I was just sueprised that Prudential did not want to issue a 1099-R in this case. I filled out a "fake" 1099-R to include taxable amount in her income.
  11. Client received a letter from Prudential regarding the gain on cash surrender value of a life insurance policy. The Cash Surrender value was $1,490.17...Cost basis was $472.07....so , according to the letter, the taxable gain is $1,016.69. Since less than $5,000.00 and policy was issued prior to August 12th, 1982, Prudential will not be issuing a 1099-R. Question....How and where do I report this gain...Sch D, 1099-R, 1099-MISC?

    I received an e-mail from Karen Fisk this morning that Ohio processed all ACKs from their end on Tuesday.....She is going to Contact ATX to see why we have not received ACKS from ATX.

  16. Thanks, Tom...This is what I suspected....but like I mentioned in my other post.....The worksheet asks in question #4 if either taxpayer or spouse was in the armed forces during 2008....."If No, stop, you cannot take the credit"......WHAT?!

My clients (married couple with 5 kids) gets to claim one of their children every other year only....Since 2007 was not their year, they only claimed 4 kids on their 2007 return, thus, their economic stimulus payment was $2,400.00. Since they claim all 5 kids in 2008, do they get that $300.00 as the recovery rebate credit?
  18. When figuring the recovery rebate credit, one of the questions asks if either taxpayer or spouse was a member of the armed forces in 2008.....I check no...and it said "No, you cannot take the credit".....really?

My next door neighbor (single mom) has mastered the maximization of her EIC.....She has realized exactly what income she can make each year that maximizes her refund with EIC....at that point she quits every year (mostly restaurants and temp jobs).....When an able-bodied person quits working just to get EIC...That is abuse!

Yes...I am disgusted by people who "take advantage" of EIC and assistance programs.....but not near as disgusted as I am with multi-millionares whos greed legally "steals" from all of us, then turns around and gets bailout money for their company...then turn around again and get a big bonus....makes a $5,000 refund with EIC seem not so bad. ...I say line up 99% of CEOs and corp execs and feed them peanut butter crackers
