  1. If you did that, the full amount they received would be taxable, but they would only get a partial credit for the expense....It would be better for your client if you netted the income with the expense to arrrive at zero
  2. I have clients that moved from Texas to North Dakota in September 2009...Can they e-file their ND state return (ND-1 and ND Sch1NR)?

  4. Due to rate table adjustments, the client had less Federtal tax withheld from his pay throughout the year. The $400.00 credit is to make up for that reduction (Fed government estimated that this reduction in federal withholding would amount to approx. $400.00 for the year). Were it not for the $400.00 credit on the return, the taxpayer would be punished for having less tax withheld...He/she is not receivig the credit twice....They received it once (as an increase in take-home pay throughout the year). The $400.00 credit on the return is so they are not punished for that. What this means to taxpayers is that if the reduction in your Federal tax withholding amounted to $400.00 for the year (all other things equal), you break even...If it was more than $400.00, it will hurt you (increase amount owed/decrease refund)...If that reduction was less than $400.00 for the year, it will help you (increase refund/decrease amount due).
  5. Client cannot remember if they received $250.00. The phone number to call suggested by Sch M do not seem to relate to my client. He received a 1099-R from Ohio Public Employee Retirement System (Ohio PERS)....Would he have received the $250.00? Does anybody know what number he should call?
  6. I just finished assisting a client who had not filed 04,05,06,07,08...Have been working with her for the past few years to get these cleared up and filed. We were doing good for a while (small refund forfeited for 04, and only small balance due for 05)...In September 09, I finally got her 06 filed. We heard nothing regarding installment payment request that we sent with 06 return, then client received notice of wage garnishment. It turns out that Kansas City "Lost" the 06 return, so IRS assessed client full balance due with interest/penalties....$24,000. The actual amount due on the return was only $3,800. Since no return was processed, IRS was placing levy against full 1099 income without regard to expenses. I called the taxpayer Advocate office for the first time....and I am happy I did. The guy who took my call and the case worker subsequently appointed were great! They worked with me in getting the wage garnishment delayed then cancelled. They assisted in getting copies of 2006 return filed with the right person and worked with me to get penalties removed and installment payment plan set up for client based on the $3,800 owed. Then she pushed 07 and 08 returns to a specific person for faster processing (as those two years had combined refund of $2,900). More importantly, they worked with me (and client directly) in a way that made them seem to be on "our side". They were very clear, knowledgeable, and easy to talk to. Client learned a lesson, I gained some experience (and a nice fee)...and now the client (and her freinds) think I am the "best tax dude ever"
  7. I sent several e-files on Monday evening...It is Wednesday morning ans some have been "Accepted", some say "transmitted to Agency", some say "Transmitted to EFC"...and at least one states "Rejected by EFC"....Cannot get through to tech support and feel "Lost" on what to do

  9. Thanks...I can see from the few logs and expense sheets that he does have that he is an intestate driver...moving loads all over the country. Others have posted the rates starting in 2006, but I will need 2005...do not know where to get that. Do I just enter that amount (days x per-diem rate)in the meals and entertainmnent area on the Schedule C?
  10. Thanks! So I could use this per diem for every day he was on the road....that way we do not need actual receipts...just log books if ever audited? Do you have any idea what rate were for 05, 06, 07....any ideas on where to look (publication number?) Thanks again
  11. OK....doing 2005 taxes for a truck driver (as well as 06,07,08,09). I have never done taxes for an independent truck driver until now, so not familiar with what types of expenses they have to offset their 1099-MISC income. I am OK on fuel, repairs, etc...but driver/client is telling me that he thinks there is a per-diem rate that can be used as an expense....a certain dollar amount for every day that he is out on the road doing runs. Is anybody familiar with this? He states that the last preparer he went to (a few years ago) just took this dollar amount/day as an expense, and told driver/client that if ever audited, he would need to go to the company that paid him to get the support (mileage, log books, etc) because he had turned them into the company. The driver/client has approx. $16,000 in 1099-MISC income, but nothing to support expenses except some fuel receipts
  12. First of all, whoever corrected the spelling error in my subject title....Thanks! Jack..I did notice the MFS vs MFJ....It actually works now!...I checked against several returns where I completed all three returns (MFJ and MFS for both spouses)...the comparison is correct down to the dollar!
  13. Just FYI for Ohio preparers (and especially those in or near Piqua. I have found that the OH SD-100 is pulling the incorrect tax rate for SD 5509 (Piqua School District). The form is calulating tax due at a rate of .005. The correct rate is .0125. I have notified ATX of the error. Until it is fixed you will need to manually "override" and enter .0125 in the rate field. I checked and all other districts (at least all in my area) are being calculated with the correct rates.

  17. Can he still get refund for 2005 (assuming there is one?) or is it too late? I cannot remember how many years you have to claim refund....Isn't it three years from original due date of return? If so, I think he is out of luck if there is a 2005 refund.
  18. The problem is that if you try to explain in a concise manner, the client generally gets a glazed look in their eyes. The main problem is that these clients are finding out after the fact when it is too late to do anything about it. I advised many clients last year to increase their withholdings...and I (and they) are thankful for that now.
  19. I just explain that "because of this credit, you had less taxes taken from each paycheck and,thus, more take-home pay each week. However, in some situations, the extra money you received is more than the amount the IRS allowed for, If so, you will owe or receive less of a refund".
  20. What about Federal taxes withheld from pay....I know the amount was reduced last year automatically due to this credit...So people saw slightly higher take-home pay. What about this year? Has or will those Federal tax withholding rates be increased to pre-credit level?
  21. Hey all...I just had to share....My daughter was accepted into the honors college at Kent State University (in Kent, OH)...Receiving some scholarship money too! She will major in Early childhood Education with specialization in special needs (mental/physical disabilities) children.

So myself, Lenny the Pirate, and Chaz (the guy on the corner by Woody's Market that drinks warm Corona) go to the Wal-Mart cuz we were all out of pop-tarts and paper towels and dog food...We were in the dog food Isle discussing the various fillers and nutritional contents. Lady comes up to me and sais "Hey...do you know where the Beeno is?....I have gas something crazy!"

  25. I went to open my ATX 2009 program yesterday and the shortcut was gone from my desktop...I went into programs and opened it from there. It attempted to update, but seemed to hang, and then shut down. On the next attempt, it appeared to update fine, but when I attempted to open a return, it shuts down. Also, one of my returns is no longer present...its just gone! My program at home is working fine, but now, this program at my office is non-functional...any ideas other than a complete re-install?
