  1. I'm not quite sure what your question is. U.S. citizens living abroad for at least 330 days during the 12-mo period are not required to purchase health insurance for that 12-mo period. They have an exemption. Are you saying you think they don't meet this exemption? Then, "he works for U of Singapore" but this form came from Vassar for most of the year. Was he here in the U.S. or was he in Singapore. Sorry, I didn't sleep at a Holiday Inn last night, or barely slept at all anywhere.

  3. Today was another crazy day. The first client of the day, an older retired gentleman, insisted that he must take off his shoes before entering my office because it was damp outside. He left his shoes outside on the steps and then sat on the damp steps to put them back on when he left. I offered him a chair but he refused that too. He's coming back tomorrow when the forecast is to be sunny and dry. Next older client called thanking me for reminding them to drop off their data. Next week it should be in my box. Tells me there no rush. Thanks! Next call was from another older woman that I'd finished/not delivered, then completed/delivered to FL by mail with additional sales tax added to Sch A, then called and said she had even more sales tax that she was going to schedule out for me. Uh, mailing time must be factored in, lady! This woman initially thought that a total of $7850 was allowed for sales tax, you know the entire standard deduction for a single! So then she up and mails back the e-file signature form to me. Now what? She called and said she wasn't sure if we were changing the return or not. She's overpaid, she can have an extension. Next lady picking up completed returns wants to chat until it's time to head out for her part-time evening job. She forgot her checkbook so I didn't get paid. It's OK, mail it tomorrow. Please just go away. Last client was a no-show. He drove home from work and forgot to stop and pick up his returns. He lives nearby but didn't want to come back out once he was home. Right, don't inconvenience yourself, only me. It's only time I could have worked on something else instead of clearing my desk. He's coming tomorrow, maybe, if he remembers. Tomorrow it will be sunny and dry.

  6. You have to amend the 2014 return. See the 2nd paragraph of this IRS page: Amending Your Return to Claim the Tax Credit If you claimed an itemized deduction for a given year for qualified foreign taxes, you can choose instead to claim a foreign tax credit that will result in a refund for that year by filing an amended return on Form 1040X (PDF) within 10 years from the original due date of your return. The 10-year period also applies to calculation corrections of your previously claimed foreign tax credit. If the foreign income taxes you claimed as a credit are refunded or otherwise reduced, you must file an amended return on Form 1040X reporting the reduced foreign tax credit. There is no time limit on this requirement.

  8. Yep, the trust will report the distribution from the IRA, and that is added in to the other income the trust might have to determine what income is ultimately distributed to the son. There are many pitfalls to naming a trust as bene of an IRA.
  9. ^ Ninja, really?! Do you use ATX? Also, I noticed in your profile that your email is to HRB. Do you still work for HRB, because I'm surprised that you are here asking for help and that you don't have resources at your disposal to answer this, or to take the question to a higher level. Many of us devote time freely to help our fellow members, mostly ATX users or those of us that started with ATX, but I'd like to think that we aren't supporting the large chain preparers that have many other resources available to them. My time is is too valuable for that.
  10. Distributions of property are reported on 1065, page 4, line 19b and will flow to the K-1s and also page 5 to M-2, line 6b.

    SIMPLE IRA

    The match is $842. The only part of the simple IRA that would be subtracted to arrive at Sch C net income is the employees' share, not the share of the sole proprietor himself. To that net result, apply the 92.35%, then use the resulting net inc from SE to calc the 3% match. The sole proprietor's contribution limit for 2015 is $12,500 and would also be allowed a $3K catch-up if he is over 50. Remember, with a simple plan it is possible to defer 100% of earnings up to that limit.

    Net income on the Sch C isn't the same as net earnings from self-employment. You have to reduce the Sch C income by the equivalent of the employer's share of FICA & Medicare taxes. In your example, is the $30,374 after applying the 92.35% to account for 1/2 of the SE tax?

  17. Try sec 708(b )(2) and Reg sec 1.708(c) under mergers and consolidations. Link is safe, goes to Cornell Edu law online library. (c) Merger or consolidation (1) General rule. If two or more partnerships merge or consolidate into one partnership, the resulting partnership shall be considered a continuation of the merging or consolidating partnership the members of which own an interest of more than 50 percent in the capital and profits of the resulting partnership. If the resulting partnership can, under the preceding sentence, be considered a continuation of more than one of the merging or consolidating partnerships, it shall, unless the Commissioner permits otherwise, be considered the continuation solely of that partnership which is credited with the contribution of assets having the greatest fair market value (net of liabilities) to the resulting partnership. Any other merging or consolidating partnerships shall be considered as terminated. If the members of none of the merging or consolidating partnerships have an interest of more than 50 percent in the capital and profits of the resulting partnership, all of the merged or consolidated partnerships are terminated, and a new partnership results.

    It should work out that the deduction on Sch A ends up being this: Total premiums on Form 8962, part 2, col A (either line 11 or total of lines 12-23) Less: Advance of PTC used during year, as shown on 8962, line 25 Less: PTC allowed on the return, as calc'd on 8962, line 26 Is the complication because the person is self-employed?

  20. Taxpayer received a corrected W-2 for 2014 that has increased the PA wages. Taxpayer works in DE so all local tax is paid with the EIT return when filed. How do I indicate the payment made with the original EIT return so that the new balance due comes down to the amount owed only on the increase in the PA wages? The locale is being handled by Keystone Collections Group in Irwin, PA if that makes a difference.
  21. That's correct. If the person doesn't itemize, then those deductions can't be included on the 8960.

    Close the return, reopen, recreate the efile and resubmit.
